Todo lo que debe saber sobre las nuevas reglas que aplican para los trabajadores independientes
El Reglamento para el Aseguramiento Contributivo de Trabajadores Independientes entró a regir el lunes 23 de mayo.
El lunes 23 de mayo se publicó en el diario oficial La Gaceta el nuevo Reglamento para el Aseguramiento Contributivo de Trabajadores Independientes.
De acuerdo con una publicación del medio digital CRHoy.com, con este reglamento se busca regular el campo de aplicación, los requisitos, el proceso y condiciones para el ingreso de los trabajadores independientes que aplican para ingresar en este régimen de contribución.
Este reglamento aplica para los trabajadores independientes, ya sean costarricenses o extranjeros, que residan en el país.
Es importante mencionar que la condición de trabajador asalariado no exime a ninguna persona de su obligación de cotizar también como independiente, en el caso de que un trabajador genere ingresos por ambas modalidades.
Respecto a las declaraciones se realizan sobre los ingresos netos que recibe cada persona, lo que significa que la CCSS no toma en cuenta el costo operativo para realizar su actividad económica.
Otro punto importante a destacar es que existe un monto mínimo para contribución obligatoria, la base mínima contributiva, y no se considerará asegurado obligatorio a aquel trabajador independiente con ingresos menores al monto mínimo de contribución establecido.
Durante los primeros seis meses de afiliación los trabajadores podrán elegir, de forma voluntaria, si se afilian y contribuyen únicamente al Seguro de Salud, o si cotizan también al Seguro de Invalidez, Vejez y Muerte (IVM). A partir del séptimo mes la cotización será obligatoria para ambos regímenes.
En este nuevo reglamento se excluyen las rentas pasivas como parte de los ingresos de los trabajadores independiente sujetos a la contribución de los seguros sociales, las cuales están definidas como: “ingresos por certificados de inversión, avales, dividendos, intereses no derivados de una actividad laboral o profesional, arrendamiento de licencias o patentes; intereses de inversiones financieras; otras formas de distribución de utilidades; dietas por participación en órganos colegiados e ingresos por alquileres”.
Las nuevas reglas establecen que en los procedimientos donde se pretende la confección de facturas adicionales por concepto de trabajador independiente, solo se considerarán los períodos cuya antigüedad no supere el plazo de los diez años.
Además se utilizará el promedio de los ingresos que llegue a determinar la Dirección de Inspección para el período de objeto de verificación. Según el documento, este procedimiento se realizaría con el propósito de determinar el cobro.
Por último el reglamento establece que los porcentajes de contribución al IVM se distribuirán entre el trabajador independiente y el Estado, de acuerdo con las escalas contributivas aprobadas por la CCSS y fundamentadas “en los estudios técnicos elaborados por Dirección Actuarial y Económica, en coordinación con la Gerencia Financiera”.
