Gobierno presenta al Congreso proyecto para congelar impuesto único de los combustibles
Como respuesta preventiva a la situación de precios internacionales de hidrocarburos a causa del conflicto bélico por la invasión de Rusia a Ucrania.
El Poder Ejecutivo presentó la mañana de este lunes al Congreso de la República, el proyecto de ley para congelar la aplicación del mecanismo de actualización del impuesto específico a los combustibles.
La medida fue anunciada por Casa Presidencial el pasado viernes 25 de febrero, ahora tendrá que pasar a análisis de la Asamblea Legislativa.
De acuerdo con la propuesta, el Gobierno congelaría el impuesto específico a los combustibles en su valor actual por un año, y renunciaría a cuatro ajustes trimestrales.
La presentación de esta iniciativa de ley se da en el marco del conflicto bélico por los ataques de Rusia a Ucrania, que han generado un incremento importante en el precio internacional del petróleo, el cual afecta los precios al consumidor y particularmente a las actividades productivas
La propuesta contiene un artículo único que detalla lo siguiente:
“ARTICULO ÚNICO. – Suspensión del mecanismo de indexación del impuesto único a los combustibles. A partir de la entrada en vigencia de esta Ley y hasta por un plazo de 12 meses contado a partir del primer día del mes siguiente a su publicación en el Diario oficial La Gaceta, se suspende la aplicación del mecanismo de actualización del impuesto específico a los combustibles, previsto en el artículo 3 de la Ley de simplificación y eficiencia tributarias, Ley 8114 del 4 de julio del 2001, publicado en La Gaceta N° 131 Alcance N° 53 del 09 de julio del 2001 y sus reformas.
En caso de que, durante el período de aplicación de esta ley, se produzca una reducción del índice de inflación respecto del vigente al momento de entrada en vigencia de esta ley, el impuesto se deberá ajustar a la baja”.
Este proyecto tiene como fin que el impuesto vigente se mantenga constante independientemente de las variaciones internas en el precio de estos productos, impidiendo con ello que los costos de producción se modifiquen por variaciones en el monto del impuesto.
“El costo fiscal de esta medida es en el mínimo de ¢10.000 millones y, si la inflación llegara a crecer de forma importante debido a este tipo de situaciones, entonces podríamos hablar de que el costo rondaría los ¢60.000 millones”, detalló el ministro de Hacienda Elian Villegas.
Por su parte, Geannina Dinarte, ministra de la Presidencia, dijo: “Nos parece que es importante establecer un acuerdo para poder dar una vía rápida alrededor de este proyecto. Creemos que es un proyecto que está no solo planteado bien técnicamente, sino que puede ser un alivio en las circunstancias que estamos enfrentando como país y también tomando previsiones de los impactos que esta situación a nivel mundial pueden llegar a generar sobre nuestro país y sobre los precios del combustible”.
Una vez que finalice el periodo de aplicación de la suspensión, el monto se actualizará sobre la base del valor del impuesto vigente en el momento de su entrada en vigencia y sobre la base de las variaciones en el Índice de Precios al Consumidor, que se experimente a partir del momento del vencimiento del plazo de la ley.
