Diputados aprueban, en segundo debate, ley que limita la reelección indefinida de alcaldes

Con 48 votos a favor y dos en contra el Plenario Legislativo dejó en firme este martes la aprobación final del expediente 21.810 Ley que Limita la Reelección Indefinida de las Autoridades Locales.
El proyecto reforma el artículo 14 del Código Municipal de la Ley N° 7794 de 30 de abril de 1998, cuyo párrafo final concede de manera irrestricta a la posibilidad de reelección.
La iniciativa establece que las alcaldesas o los alcaldes podrán ser reelegidos de manera continua por una única vez, no podrán ocupar ningún cargo de elección popular del régimen municipal hasta tanto no hayan transcurrido dos periodos desde que finalizó su segundo periodo consecutivo.
Además los vicealcaldes y las vicealcaldesas también podrán ser reelegidos de forma continua por una única vez y no podrán ocupar el mismo cargo ni el de regidores o síndicos hasta tanto no hayan transcurrido dos periodos desde que finalizó su segundo periodo consecutivo.
Para el legislador del Partido Frente Amplio, José María Villalta Florez-Estrada, la aprobación final del proyecto fortalece la democracia costarricense, el régimen municipal y los mismos partidos políticos.
Por su parte el diputado Daniel Ulate Valenciano del Partido Liberación Nacional (PLN) justificó su voto negativo al proyecto asegurando que limitar la reelección de las autoridades municipales es desconocer la carrera administrativa municipal que adquieren esos funcionarios.
Mientras que la legisladora oficialista Laura Guido Pérez, al anunciar su apoyo a la iniciativa, recalcó que la concentración absoluta de poder en las municipalidades ha generado compadrazgos y complacencias dentro de las estructuras municipales.
Guido aseguró que en la norma electoral debe existir un espacio a la alternancia del poder y al principio de oportunidad para que las diferentes fuerzas puedan participar en igualdad de condiciones.
El diputado del PLN, Carlos Ricardo Benavides Jiménez, lamentó que a partir de la aprobación del proyecto el país se va a quedar sin la participación de buenos alcaldes, pero reconoció que limitar la reelección consecutiva genera mejores espacios para el desarrollo de la institucionalidad democrática y evita abusos en el ejercicio del poder.
