Caso “Diamante”: Juzgado levanta suspensión del cargo a alcaldes investigados
Las medidas cautelares como impedimento de salida del país y entrega de pasaporte se mantienen.
El Juzgado Penal de Hacienda y de la Función Pública del Segundo Circuito Judicial de San José, en Goicoechea, ordenó la noche de este lunes levantar la suspensión del cargo a los alcaldes investigados por el Caso “Diamante”.
Ellos fueron detenidos el 15 de noviembre del 2021 por, supuestamente, recibir presuntos sobornos para facilitar contratos de obras públicas.
Los seis alcaldes investigados son: Johnny Araya, del cantón central de San José; Humberto Soto, del cantón central de Alajuela, Mario Redondo, del cantón central de Cartago; Arnoldo Barahona, de Escazú, Alfredo Córdoba, de San Carlos y Alberto Cole, de Osa.
Fueron puestos en libertad dos días después y en esa misma semana la jueza Juliana Jiménez les dictó seis meses de suspensión del cargo.
Además de ordenar la reinstalación en el puesto a cada alcalde, se mantienen las medidas cautelares como impedimento de salida del país y entrega de pasaporte.
En el caso del imputado de apellidos Gutiérrez Vargas, se ordenó el cese de arresto domiciliario por variación, domicilio fijo y actualizado, además, firmar una vez al mes, y también el impedimento de salida del país y entrega pasaporte.
A él se le señala por aparentemente ser el enlace con los gobiernos locales.
Al imputado apellidado Cruz Porras se le mantiene impedimento de salida y entrega pasaporte, se suprime no acercarse a testigos.
Para los demás funcionarios municipales investigados quedan sin efecto todas las medidas.
La Fiscalía había solicitado que los alcaldes se mantuvieran suspendidos un año más, sin embargo, no se acogió la petición.
Durante los seis meses, los funcionarios no recibieron salario por solicitud propia o por decisión de los Concejos Municipales y la Administración de los Gobiernos locales.
Pese a que las medidas cautelares cambiaron, los alcaldes continúan vinculados a la causa judicial conocida como “Diamante” y el proceso judicial continúa.
