Empresario demandó al Banco Nacional por presuntas irregularidades con un crédito de $8.5 millones
El crédito se otorgó en el 2012.
Según se dio a conocer el Banco Nacional fue demandado por un empresario costarricense, quien denunció presuntas irregularidades con un crédito de 8.5 millones de dólares que se otorgó en el 2012.
Dicha demanda fue planteada en el Tribunal Contencioso Administrativo en el expediente 18-001053-1028-CA, y la misma señala una presunta administración fraudulenta y el otorgamiento del crédito a dos sociedades que en apariencia no contaban con los requisitos respectivos.
En cuanto a las presuntas irregularidades que se mencionan en la demandan sobresale lo siguiente:
- La representante del Banco que otorgó el crédito de $8.5 no contaba con la capacidad jurídica suficiente.
- Las personas representantes de las sociedades a las que les prestaron el dinero solo podían endeudarse por $10 mil dólares.
- Se aceptó como fiadores a los mismos representantes de las sociedades deudoras y se eximió de estudio crediticio.
- En apariencia no se dio un plazo de gracia al capital de 24 meses sin que se cancelaran especies fiscales.
- No se ha encontrado estudio de prefactibilidad y factibilidad.
- Las operaciones del proyecto se cerraron el 10 de abril de 2014.
- El crédito entró en morosidad y representó pérdidas económicas para el banco.
Por otra parte, según dio a conocer CRHoy.com, los denunciantes indicaron que en dicho documento “existen las pruebas suficientes para probar una apropiación indebida del proyecto, pues la iniciativa del proyecto había sido presentada y registrada, pero luego apareció como una autoría de las dos sociedades que recibieron el crédito. El proyecto fue registrado desde el 2008 en el Registro Nacional de Derechos de Autor y Derechos Conexos”.
En cuanto al proyecto, este estaba relacionado con el reciclaje, esto por medio de la utilización de botellas plásticas usadas para la creación de una resina, misma que por medio de diferentes procesos, serviría para crear nuevas botellas de plástico.
