¡Tómelo en cuenta! La vacuna contra la covid-19 sigue siendo obligatoria para todos los funcionarios públicos y trabajadores privados cuyos patronos así lo consideren.
Esto significa que si los trabajadores se oponen a rechazar las dosis podrán ser sancionados y hasta despedidos. Algo muy diferente a lo que el presidente de la República, Rodrigo Chaves Robles, indicó en la conferencia de prensa del pasado miércoles.
Chaves, y la ministra de Salud, Joselyn Chacón, indicaron que como dos miembros de la Comisión Nacional de Vacunación y Epidemiología (CNVE) tienen sus nombramientos vencidos la vacuna contra el covid-19 dejó de ser obligatoria.
Aseguraron que los actos acordados por la comisión fueron inválidos en el momento que se vencieron los nombramientos.
En primer lugar hay que recordar que el único órgano en Costa Rica que puede establecer si una vacuna es obligatoria o no es la Comisión Nacional de Vacunación y Epidemiología (CNVE).
Así lo determinó el 23 de setiembre del 2021 cuando acordó la obligatoriedad de las dosis contra la covid-19 para todos los empleados públicos y privados que no posean contraindicación médica. Esa directriz continúa vigente al día de hoy.
Con esta determinación se facultó a los patronos a exigir a sus trabajadores la aplicación de las dosis, así como establecer sanciones para quienes se negaran a aplicarse el biológico sin certificar alguna situación de salud que se lo impida.
En caso de que los trabajadores que no quieran vacunarse el patrono es el responsable de tomar las medidas correspondientes, por lo que las sanciones por no acatar la medida se aplican según lo que disponga cada empresa.
La abogada laboralista Paola Gutiérrez explicó al periódico La Nación que este análisis de los jerarcas es incorrecto porque hasta este momento continúan vigentes los decretos 42889-S y 43249-S, mediante los cuales se incluyó la inmunización contra la covid-19 en la lista de las vacunas obligatorias definida por la CNVE, además, se estableció su obligatoriedad para todos los funcionarios públicos y trabajadores privados cuyos patronos lo exijan.
Gutiérrez agregó que hace dos meses la CNVE ratificó la obligatoriedad de las dosis contra el nuevo coronavirus cuando le respondió a la ministra de Salud su consulta sobre cuáles son los criterios técnicos y científicos para mantener la medida.
También, la abogada recordó que sigue vigente el criterio de la Dirección de Asuntos Jurídicos del Ministerio de Trabajo y Seguridad Social (MTSS), emitido el 12 de octubre de 2021, sobre el procedimiento para establecer sanciones y hasta el despido a empleados que se opongan a vacunarse contra la covid-19.
Solo un juez lo puede anular
Esteban Alfaro, especialista en derecho administrativo, manifestó a La Nación que decir que los acuerdos de la CNVE son ilegales solo porque dos miembros tienen sus nombramientos vencidos es incorrecto, porque solo el Poder Judicial puede determinar eso por medio de resoluciones del Tribunal Contencioso Administrativo o de la Sala Constitucional.
