Keyla Sánchez tiene derecho a apelar resolución emitida por el INS
La presentadora tiene hasta cuatro años para apelar.
Si usted pensó que el tema sobre el estrepitoso accidente que protagonizó Keyla Sánchez ya había terminado, le contamos que más bien está en sus primeros capítulos.
Recordemos que el 31 de marzo anterior, el país amaneció con la noticia de que Sánchez había sufrido un aparatoso accidente en la ruta 27 a la altura de Ciudad Colón.
La presentadora perdió el control de su auto, una camioneta Chevrolet Tahoe 2021 full extras valorada cerca de los 99 mil dólares, antes de ingresar a la caseta del peaje colisionando de forma aparatosa contra el muro de contención.
No se había hablado más del tema hasta este sábado cuando desde muy tempranito el controvertido youtuber y presentador Diego Bravo divulgó unos documentos, aparentemente expedidos por el Instituto Nacional de Seguros (INS), relacionados con el percance que tuvo la presentadora de ‘Calle 7’.
En los papeles se indica que, presuntamente, el INS le negó la cobertura de los daños del accidente a Sánchez porque iba en estado de ebriedad, esto según el parte médico del Hospital San Juan de Dios (HSJD). Pese a que la ramonense negó en todo momento que estaba bajo los efectos del licor, en la entidad decidieron no pagarle el seguro por una serie de inconsistencias que encontraron en la declaración de la presentadora y en las pruebas.
Sin embargo, la ramonense tiene derecho a apelar la resolución dictada por la aseguradora estatal.
Así lo explicó el asesor jurídico de Aselecom Abogados, Kendall Jiménez Ruiz a NCR Noticias Costa Rica.
“Ella tiene cuatro años para apelar con el INS y si aún el INS le resuelve en contra puede irse a la sede contencioso- administrativa a pelear”, indicó.

Este sábado el youtuber Diego Bravo divulgó unos documentos, aparentemente emitidos por el Instituto Nacional de Seguros (INS), relacionados con el estrepitoso accidente que tuvo la presentadora de ‘Calle 7’ Keyla Sánchez en la ruta 27.

Tras darse a conocer la noticia muchos se preguntan si el accionar de Bravo fue el correcto tras filtrar y hacer pública la resolución del INS.
El abogado Kendall Jiménez Ruiz aseguró a NCR Noticias Costa Rica que compartir resoluciones privadas sin consentimiento es un delito.
“Según la regulación del Código Penal será reprimido con prisión de seis meses a un año, el que usare indebidamente en cualquier forma, cartas, papeles, grabaciones, despachos telegráficos, telefónicos, cablegráficos o de otra naturaleza que hubieren sido sustraídos o reproducidos”, explicó el abogado.
“Será reprimido con treinta a sesenta días multa, si el hecho pudiere causar perjuicio, al que hallándose legítimamente en posesión de una correspondencia, de papeles o grabaciones no destinadas a la publicidad, las hiciere públicas sin la debida autorización, aunque le hubieren sido dirigidas. La pena será de treinta a cien días multa, si la información propalada tuviere carácter privado, aun cuando no causare perjuicio”, agregó.
Jiménez Ruiz explicó además que: “Será reprimido con prisión de un mes a un año o de treinta a cien días multa, el que teniendo noticias por razón de su estado, oficio, empleo, profesión o arte, de un secreto cuya divulgación pueda causar daño, lo revele sin justa causa. Si se tratare de un funcionario público o un profesional se impondrá, además inhabilitación para el ejercicio de cargos y oficios públicos, o de profesiones titulares, de seis meses a dos años”.
Además, el abogado aseguró que cuando se trate de información de las entidades o empresas supervisadas por las superintendencias del Sistema Financiero Nacional, o de los clientes de dichas entidades o empresas, cuando tal información esté protegida por el secreto, la confidencialidad o la prohibición de divulgación la pena será de cuatro a seis años de prisión.
Jiménez indicó también que si la divulgación la realiza un funcionario público se impondrá la inhabilitación para el ejercicio de cargos y oficios públicos o de profesionales titulares de uno a tres años.
