Gobierno presenta reformas para excluir de regla fiscal al PANI y a la CNE
Proyectos protegerían a mujeres y niños, y facultaría a la CNE para hacer uso ampliado de recursos en caso de emergencias.
El Gobierno de la República presentó este martes a la Asamblea Legislativa dos reformas que pretenden ajustar la aplicación de la regla fiscal al Patronato Nacional de la Infancia (PANI) por una única vez y a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) en los casos de emergencias que se prolonguen por más de 2 años.
En el caso del PANI, con la“Ley de Reactivación y Reforzamiento de la Red Nacional de Cuido y Desarrollo Infantil”, se reformaron varios artículos a la Ley N.° 9220 buscando fortalecer la Red Nacional de Cuido, dotándola de mejores herramientas y financiamiento.
Esta ley es posterior a la Ley N.° 9635, Ley de Fortalecimiento de las Finanzas Públicas, que estableció la regla fiscal e implica necesariamente un aumento presupuestario en el PANI, por lo que la reforma presentada hoy buscará excluir estos recursos por una única vez de la regla fiscal, para establecer la nueva base de cálculo, a partir de la cual el PANI tendrá que seguir aplicando en adelante la regla fiscal.
Por otro lado, se presentó la reforma al inciso del artículo 16 de la Ley N° 9635 del 3 de diciembre del 2018, Ley de Fortalecimiento de las Finanzas Públicas, para ampliar el plazo de dos años que establece dicha ley para las cláusulas de escape de la regla fiscal en caso de emergencia nacional.
La reforma buscará garantizar en nuestro marco jurídico la habilitación para que la CNE pueda enfrentar situaciones de emergencia nacional que se prolonguen en el tiempo, como es el caso de la actual pandemia, al adicionar eventos que se prolonguen por plazos mayores a los dos años y que se mantenga el nexo de causalidad que permita demostrar la necesidad de aplicar la excepción más allá del plazo de los dos años actual.
Ambas reformas fueron firmadas por el presidente de la República, Carlos Alvarado, y el ministro de Hacienda, Elian Villegas.
Adicionalmente, la reforma del PANI fue firmada por la ministra de Trabajo y Seguridad Social, Silvia Lara y por el ministro de Desarrollo Humano e Inclusión Social, Juan Luis Bermúdez.
