Llamada telefónica cambiaría el rumbo del caso sobre la muerte de María Tacsan
Un rastreo telefónico indica que Tacsan conversó con su madre cuando, de acuerdo con la autopsia, ella ya estaba muerta.
Un rastreo del teléfono fijo de la vivienda donde habitaba María del Carmen Tacsan Ulate reveló que ella conversó alrededor de nueve minutos con su madre a una hora en que según la autopsia realizada por Medicatura Forense del Organismo de Investigación Judicial (OIJ) la mujer ya estaba sin vida.
Este elemento fue uno de los que más pesó en la decisión del Tribunal de Apelación de Sentencia Penal de San Ramón, de ordenar el levantamiento de la prisión preventiva contra el esposo de la mujer, un hombre de apellidos Pérez Hernández, a quien el Ministerio Público atribuye el delito de feminicidio. Esta información fue dada a conocer por el periódico La Nación.
El 26 de setiembre del año anterior autoridades del Organismo de Investigación Judicial (OIJ) dieron a conocer que un médico radiólogo, de apellidos Pérez Hernández de 42 años, fue detenido como sospechoso de la muerte de su esposa identificada como María Tacsan Ulate de 40 años. El suceso ocurrió el sábado 19 de setiembre.
En aquel momento la Fiscalía indicó que el día de los hechos María y Carlos se encontraban en su casa de habitación ubicada en San Rafael de Heredia. Aparentemente Tacsan decidió terminar con la relación y le solicitó el divorcio al radiólogo pocos días antes del 19 de setiembre.
Luego, el sujeto dio aviso a las autoridades indicó que su esposa se había suicidado y que él acababa de encontrar el cuerpo porque no se encontraba en la vivienda.
Por medio de los hallazgos obtenidos a través de la autopsia médico legal al cuerpo de Tacsan, se determinó que se estaba ante un homicidio y no ante un suicidio. De acuerdo con el reporte, la mujer falleció entre las 8 a. m. y las 11 a. m. Tenía varias heridas de arma blanca, así como un disparo en el cielo de la boca, el cual la dejó sin vida.
Además, las primeras investigaciones judiciales indicaron que, en apariencia, el acusado mintió al decir que no se encontraba en la casa cuando ocurrió el fallecimiento.
Bajo esa hipótesis agentes del OIJ detuvieron a Pérez Hernández, el 26 de setiembre de 2020 en su vivienda, por ser sospechoso del delito de feminicidio.
Llamada telefónica genera dudas
Desde el día de su captura, Pérez Hernández, se mantuvo en prisión preventiva. Debido a que este domingo cumple un año de estar en esa condición, la ley indica que solo el Tribunal de Apelación de Sentencia puede autorizar una prórroga.
Ante esto la Fiscalía realizó la gestión respectiva y solicitó extender la medida cautelar por seis meses más.
El abogado defensor, José Miguel Villalobos Umaña, detalló a La Nación que en ese momento se rechazó la pretensión “en virtud de una serie de indicios nuevos que han generado una disminución o desaparición del grado de probabilidad delictiva que él (el imputado) sea culpable de la muerte de su esposa, María Tacsan”.
“Me opuse (a la extensión de la medida) con base en dos razones. La primera, que durante un año el Ministerio Público desperdició meses sin investigar nada, pese a que la defensa solicitó que abrieran los celulares de él y de ella para determinar si había llamadas, mensajes y demás; que hicieran estudios de huellas digitales del arma, en la bolsa plástica, en el bisturí, de rastros de pólvora en las manos de ella. Nada de eso se hizo a pesar de que todos esos objetos están decomisados desde setiembre del año pasado. Es realmente increíble”, agregó el jurista.
Villalobos indicó que el expediente ya consta de la autopsia y de un estudio de rastreo de llamadas telefónicas del teléfono fijo del apartamento donde residía el matrimonio.
“El Ministerio Público ha sostenido que el doctor Pérez es el único que podría haber matado a María del Carmen porque salió de la casa ese 19 de setiembre a las 10:36 a. m. y regresó a las 5:58 p. m. Nadie más entró o salió del apartamento por los videos de seguridad y sostiene, según la autopsia, que ella había muerto entre las 8 a. m. y las 11 a. m. y por eso insisten que la mató entre las 8 a. m. y las 10:36 a. m.
“Pero con la nueva prueba del rastreo de llamadas se llegó a determinar que desde el teléfono fijo del apartamento se hizo una llamada a las 11:39 a. m. y durante nueve minutos hubo una conversación con la madre de la víctima (…) bueno la madre dice que ese día habló con su hija, lo que parece significar, claro obviamente esto requiere una investigación más profunda, de que María del Carmen estaba viva faltando un cuarto para las doce y sí estaba viva a esa hora y el doctor se fue a las 10:36 a. m. y no volvió hasta el final del día, el doctor no la pudo haber matado. Es imposible”, agregó.
Pero también la autopsia arrojó otro importante dato: cuando se detuvo a Pérez se dijo que Tacsan murió luego de que le fracturaron el hueso hioides de la laringe, aparentemente mediante la aplicación de un candado chino. Pero tras la la inspección se determinó que dicha estructura ósea no está fracturada.
El abogado Villalobos comentó que a raíz de estas circunstancias el Tribunal solicitó a la Fiscalía realizar un estudio a profundidad sobre la llamada telefónica y la hora del deceso de María Tacsan.
