Fiscalía solicita quitar fianza y dictar cárcel a propietarios de H.Solís y MECO
Ministerio Público busca que el expediente del caso “Cochinilla” sea devuelto al juzgado para analizar las medidas cautelares.
El Ministerio Público solicitó al Tribunal Penal de Hacienda que quite la fianza de $3 millones impuesta a Mélida Solís, propietaria de la constructora H.Solís y de $5 millones a Carlos Cerdas, dueño de MECO y en su lugar se dicte prisión preventiva.
La solicitud fue presentada por la Fiscalía en la audiencia donde se analizan las medidas cautelares impuestas a las 28 personas investigadas en el caso “Cochinilla” en el que se investiga a funcionarios del Gobierno y de empresas privadas por la supuesta malversación de fondos destinados a la construcción de obra pública.
La solicitud que presentó la Fiscalía está fundamentada en que las medidas sustitutivas (imposición de fianzas, impedimento de salida del país y no tener contacto con testigos) no son suficientes para hacerle frente a todos los peligros procesales, pues indicaron que tal vez el peligro de fuga estaba cubierto pero no así riesgo de reiteración delictiva y de obstaculización de la investigación.
El abogado Erick Gatgens, uno de los defensores de Mélida Solís, dueña de la empresa H Solís declaró al periódico La Nación: “En el caso de doña Mélida, indicó que las medidas sustitutivas no son idóneas para hacerle frente a los peligros procesales. Ellos son de la tesis que la única medida que es suficiente para tales efectos es la prisión preventiva.
En casos anteriores, cuando un tribunal revoca la medida cautelar dictada el asunto vuelve de nuevo a conocimiento del juzgado para que emita una nueva resolución.
La audiencia de apelación de medidas del paso “Cochinilla” continuará este jueves.
