Fernando Cruz cataloga de “tortura” el nivel actual de hacinamiento carcelario
“En el fondo tradicionalmente hemos considerado que el encarcelamiento es como un asunto de segundo orden”, aseguró el presidente de la Corte.
El presidente de la Corte Suprema de Justicia, Fernando Cruz, externó su preocupación por el nivel actual del hacinamiento carcelario en el país y aseguró que si es mayor al 20 % representa una tortura para los privados de libertad.
“Lo que tienen que hacer es respetar al 20% de sobrepoblación máxima y si se supera eso hay que hacer un plan para que se haga un cronograma de cumplimiento de penas, porque superar eso es convertir la pena de prisión en una tortura. Como que no hay sensibilidad con ese tema. En el fondo tradicionalmente hemos considerado que el encarcelamiento es como un asunto de segundo orden”, declaró Cruz a Noticias Monumental.
El presidente de la Corte aseguró que las celdas del Organismo de Investigación Judicial (OIJ) no fueron hechas para que las personas permanezcan más de dos días en prisión.
“Todas esas situaciones que estamos enfrentando es porque las celdas del OIJ no se hicieron para una permanencia mayor a 48 horas y por otra parte no hay que olvidar que los jueces de ejecución son jueces, yo no les puedo decir a ellos cómo valorar, son jueces de garantías y garantías en algo tan delicado como es privar de libertad a un ciudadano”, indicó Cruz.
Según recoge Noticias Monumental, actualmente las órdenes de los jueces impiden el ingreso de los reos indiciados en ocho de las nueve cárceles donde se puede ubicar a este tipo de población.
A esto se le suma que los juzgados de Ejecución de la Pena negaron al Ministerio de Justicia trasladar a los reos a espacios de las prisiones como gimnasios.
Todo esto provoca que las personas aprehendidas se acumulen en las celdas de los tribunales y permanezcan en el lugar por varios días a causa de que Justicia no posee los espacios disponibles para ubicarlos en las cárceles.
