Gobierno gestiona reforma a Ley de Salud para agilizar intervenciones en fiestas privadas
Esto tras el rechazo de jueces a solicitudes de allanamiento y el crecimiento de casos de covid-19.
Este jueves durante la conferencia de prensa para dar a conocer el cierre de comercios no esenciales en 45 cantones de la Región Central del país el ministro de Salud, Daniel Salas Peraza, anunció que el Gobierno presentará una iniciativa de ley ante la Asamblea Legislativa con el objetivo de agilizar las intervenciones en fiestas privadas durante la emergencia sanitaria por la covid-19.
Según el jerarca, se trata de una leve reforma al artículo 347 de la Ley General de Salud, que permite a las autoridades sanitarias presentar solicitudes de allanamiento en propiedades donde se efectúen eventos que atenten contra la salud pública.
Estas órdenes deben contar con el aval de las entidades judiciales.
“El artículo, ahora como está, nos dice que los jueces deberán dar esa solicitud de allanamiento siempre que corresponda en las siguientes 24 horas, pero es claro que esta situación que estamos viviendo amerita una respuesta mucho más ágil y rápida”, comentó Salas.
Actualmente el apartado indica lo siguiente:
“En el caso que las personas físicas o jurídicas impidieren la entrada o acceso a los lugares o inmuebles o interfirieren con la actuación de los funcionarios o se negaren a la entrega de muestras y antecedentes, podrá la autoridad de salud solicitar de la autoridad judicial la orden de allanamiento, la que deberá ser dictada dentro de las veinticuatro horas naturales de solicitada. Los funcionarios del Ministerio a quien se les encomiende tal diligencia, practicarán el allanamiento debiendo sujetarse a las disposiciones legales pertinentes y a las disposiciones administrativas y técnicas de procedimientos del Ministerio. El allanamiento tendrá por objeto realizar únicamente la diligencia específica para la que ha sido solicitada por la autoridad de salud y los funcionarios que la cumplan responderán de todo perjuicio innecesario causado por su actuación o por la extralimitación en sus funciones”.
Este anuncio se da luego de múltiples reportes de actividades realizadas en propiedades privadas en momentos en donde el nuevo coronavirus golpea con fuerza al país.
Un ejemplo de ello ocurrió el sábado anterior, cuando un juez rechazó una solicitud de allanamiento en una finca ubicada en el sector de Fraijanes en Alajuela donde se efectuó una boda en la que habrían participado alrededor de 350 personas.
Oficiales de la Fuerza Pública se apersonaron al lugar para dispersar el evento y evitar el riesgo de contagio masivo, sin embargo, los organizadores no dieron autorización para que ingresaran a la propiedad.
