Hombre recibirá reembolso de pensión tras descartarse paternidad de niña
En un arranque de ira la mujer confesó al hombre que menor no era su hija.
El Juzgado de Familia del Segundo Circuito Judicial de San José ordenó a una mujer a reintegrar el pago de las pensiones alimentarias recibidas de un hombre que, después de una prueba de paternidad, descubrió que no era el padre biológico de una menor de 17 años.
Según informó el medio AmeliaRueda.com la resolución se dio en diciembre de 2022, pero trascendió este miércoles. El caso judicial viene anonimizado porque en el escenario planteado aparece una persona menor de edad.
El Juzgado concedió la petición del hombre basándose en el artículo 86 del Código de Familia, que permite impugnar el reconocimiento en caso de falsedad o error. El hombre afirmó que la menor no era su hija y solicitó que se le notificara a la Dirección General del Registro Civil.
La demanda citó que desde 2005 la mujer había indicado al hombre que estaba embarazada y que el bebé era suyo. Según el documento judicial, el hombre comenzó a tener dudas sobre la paternidad en 2007.
La resolución judicial reconoció que el dictamen aportado en la acusación no se admitía debido a que no se acreditaba su reconocimiento por la Corte Suprema de Justicia.
Sin embargo, el dictamen de paternidad de 2022 del Organismo de Investigación Judicial (OIJ) concluyó que el denunciante no era el padre biológico de la menor.
El juzgado reconoció que la mujer había aceptado que el bebé era del hombre, presentando fotografías del té de canastilla donde, según ella, el hombre no mostró dudas sobre la paternidad.
La resolución señaló que la única persona que tenía la información acerca de la posibilidad de que la bebé no fuera del novio era la mujer. El juzgado afirmó que si ese escenario hubiera ocurrido, se debió alertar para hacer la prueba de paternidad.
El fallo ordena a la madre que reintegre las sumas de dinero aportadas para la manutención de la menor, aunque no se especifica la cantidad en la resolución.
