Este lunes inicia juicio contra Albino Vargas por llamado a bloquear fronteras y vías nacionales
“Esto es un juicio político”, aseguró el líder sindical a su llegada al Tribunal Penal del I Circuito de San José.
El secretario general de la Asociación Nacional de Empleados Públicos y Privados (ANEP), Albino Vargas Barrantes, tendrá que hacerle frente a un juicio en su contra por el presunto delito de instigación pública a raíz de el llamado que hizo a bloquear calles y fronteras en marco de una protesta en la que se exigía la renuncia del exministro de Educación, Edgar Mora Altamirano, en 2019.
La denuncia por ese caso fue presentada en setiembre de ese mismo año por los abogados Gloria Navas y Rubén Hernández Valle luego de unas declaraciones que realizó Vargas en el auditorio de la Conferencia Episcopal, el 9 de setiembre de 2019. En la reunión, el dirigente exhortó a los miembros de la llamada Mesa Social Multisectorial a realizar cierres.
“La tesis de paro nacional es correcta, un gran paro nacional, pero de verdad: cerrar las fronteras, cerrar la 27, cerrar la 32, cerrar Ochomogo…, hasta obligar a que se sienten en la mesa los que nos ningunean”, declaró Vargas en aquel momento.
El debate se llevará a cabo desde este lunes 6 y se extenderá hasta el próximo viernes 10 de diciembre en la sala 1 del Tribunal Penal del I Circuito de San José. Así lo dio a conocer el medio AmeliaRueda.com.
Según indica el texto de la denuncia, los abogados hicieron el reclamo con base en el artículo 27 de la Constitución Política, el 280 del Código Penal en el que se describe el delito de instigación pública y la pena que le corresponde.
“Instigación pública. Artículo 280.- Será reprimido con la pena de seis meses a cuatro años de prisión, el que instigare a otro a cometer un delito determinado que afecte la tranquilidad pública, sin que sea necesario que el hecho se produzca”, reza la ley.
A la causa penal contra el líder sindical se unió la Procuraduría General de la República y el Ministerio Público.

A su llegada al Tribunal Penal del I Circuito Judicial de San José, Vargas aseguró que se trata de un juicio político.
“Esto es eminentemente un juicio político debe quedar claro. Aquí se unió Carlos Alvarado Quesada a través de la Procuraduría General de la República, obviamente el Ministerio Público y esta señora Gloria Navas. Nosotros creemos que este es un juicio político porque lo que buscan estas entidades que nos acusan es acallarnos, silenciarnos considerando la relevancia que tiene en una sociedad costarricense en donde crece la desigualdad, la movilización social”, declaró el líder sindical al medio CRHoy.com.
“Nosotros ratificamos nuestro criterio en que en una democracia representativa tan degenerada como la tica en estos momentos la democracia participativa, que nosotros llamamos la democracia de la calle, adquiere una connotación estratégica de primer orden”, agregó.
La causa de Vargas se tramita bajo el expediente 19-000647-0619-PE.
