El presentimiento del director del OIJ sobre caso “Cochinilla”: “Nadie quiere comerse ese chicharrón”
“El sistema penal costarricense tiene que demostrar que es capaz de manejar casos de esta envergadura», manifestó Walter Espinoza.
Las medidas cautelares dictadas a los investigados por el caso “Cochinilla” indignaron a los costarricenses el sábado anterior, pero algunos intendidos en el tema como el jerarca del Organismo de Investigación Judicial (OIJ), Walter Espinoza ya esperaban que ninguno de los 28 imputados que estuvieron en las cárceles judiciales por casi dos semanas iba a tener que enfrentar a la medida cautelar de prisión preventiva.
Así lo manifestó el viernes anterior en Interferencia, medio de comunicación de la Universidad de Costa Rica (UCR).
El Juzgado Penal de Hacienda y de la Función Pública indicó que a Mélida Solís Vargas, dueña de H. Solís se le fijó una fianza de $3 millones de dólares mientras que al dueño de MECO, Carlos Cerdas, se le interpuso una caución real por $5 millones de dólares a cambio de su libertad.
Ante las medidas que causaron indignación la Fiscalía Adjunta de Probidad, Transparencia y Anticorrupción (Fapta) apeló el fallo contra la determinación hacia Solís y Cerdas así como las dictadas contra otros 11 sospechosos.
Regresando a las declaraciones de Espinoza para Interferencia, el jerarca manifestó que ha sido complicado para el sistema penal del país darle trámite a un caso tan complejo como “Cochinilla”.
“La dilución de los casos en el tiempo, pues genera la posibilidad de no entrarles, usted ve casos muy viejos y dice, ‘¡Por Dios! ¿Por qué no lo han acusado?¿Por qué no ha ido a juicio?’, en realidad nadie quiere, como dicen, comerse un chicharrón de esos, entonces es sumamente difícil”, aseguró.
Espinoza indicó que la Policía Judicial colabora en lo necesario para que el caso sea llevado a las últimas instancias, pero destacó que el OIJ no es el único actor en este proceso.
“El sistema penal está a prueba y esta es una circunstancia que debe atender, hay un compromiso y una promesa del OIJ de ayudarle a la Fiscalía de manera total y absoluta para que logre articular acciones dirigidas a que esto lo pueda acusar pronto y ese compromiso nosotros lo cumplimos con convicción y dignidad total, las otras partes tiene que ver con los jueces, los defensores y la propia Fiscalía”, acotó el funcionario.
Además el director del OIJ dijo que espera que no surjan obstáculos en el desarrollo del caso.
“Yo esperaría que en algún momento hasta un imputado de estos pudiese decirle a la población: ‘Sí, yo fui’, si la prueba es clarísima, son personas preparadas, son imputados que tienen posibilidades académicas, ¿van a decir que esa no es su voz?, ¿qué esa no es su conversación o teléfono?, yo todavía tengo esperanza”, expresó Espinoza.
