¿Tiene dudas de cómo funcionará el feriado del 15 de setiembre? Acá les explicamos
El disfrute de algunos feriados se han cambiado a lunes, acá les comentamos si sucederá igual con el 15 de setiembre o no.
Con la aplicación de la Ley 9.875, que trasladaba desde el 2020 algunos de los días festivos a los lunes, con el objetivo de fomentar el turismo en Costa Rica con un fin de semana largo, a muchas personas les ha surgido la duda si esto sucederá también con el próximo feriado del 15 de setiembre que celebramos la Independencia de Costa Rica.
Cabe destacar que en este caso dicha ley no se aplica, es decir el disfrute de esta festividad queda para el propio día, el viernes 15 de septiembre.
Con respecto al feriado del 15 de setiembre, las autoridades correspondientes recuerdan que es de pago obligatorio y de acuerdo con el Ministerio de Trabajo:
“Todos los trabajadores tienen derecho a disfrutar del feriado, por ese motivo, no se puede obligar a trabajar a nadie, únicamente si están de acuerdo. Si se oponen a trabajar en el feriado, no pueden ser sancionados por esa causa. Se exceptúa de esta regla puestos esenciales para el país como cruzrojistas, bomberos y policías.
“Para el tema del pago, las empresas que pagan semanalmente (en actividad no comercial), es decir, que reconocen en el salario solo el tiempo efectivamente laborado, deben pagar los días trabajados durante esa semana y agregar un salario sencillo por el día feriado. Si se trabaja en el feriado, el salario adicional deberá ser doble el 15 de setiembre”, detalla el Ministerio.
Asimismo, cabe destacar que las empresas donde pagan por mes, quincena o semana en actividad comercial, y reconocen el salario de todos los días del mes, aunque sean descansos semanales o feriados, deberán cumplir con el salario completo de la semana, quincena o del mes, incluyendo el feriado.
