Sala IV no encontró inconstitucionalidades en proyecto de legalización de cannabis medicinal
El Poder Ejecutivo presentó de forma inmediata la convocatoria de esta iniciativa en el periodo de sesiones extraordinarias.
La Sala Constitucional de la Corte Suprema de Justicia notificó a la Asamblea Legislativa que el proyecto de Ley del Cannabis para Uso Medicinal y Terapéutico y del Cáñamo para uso Alimentario e Industrial, expediente 21.388, no presenta ninguna de las inconstitucionalidades de procedimiento ni de fondo que fueron alegadas por un grupo de diputados.
Con esta decisión la Sala IV dio luz verde para que la iniciativa continúe su avance en la Asamblea Legislativa.
Ante la resolución, el Poder Ejecutivo incluyó de forma inmediata esta iniciativa en la agenda del Congreso para que se discuta en segundo debate.
“Ante la resolución emitida este martes por la Sala Constitucional, en la cual indica que no hay inconstitucionalidades en el proyecto de Ley del Cannabis para Uso Medicinal y Terapéutico y del Cáñamo para uso Alimentario e Industrial (expediente 21.388), el Poder Ejecutivo presenta de forma inmediata la convocatoria de esta iniciativa en el periodo de sesiones extraordinarias, para que una vez que llegue la sentencia integral se proceda con su conocimiento”, indicó Geannina Dinarte Romero, ministra de Presidencia.
“Instamos a la Asamblea Legislativa a continuar con la aprobación del proyecto de empleo público, así como con otras iniciativas que son fundamentales para el país, tanto en materia de reactivación económica como de consolidación de la ruta fiscal, las cuales se encuentran en el plenario legislativo”, agregó.
De aprobarse el proyecto solo faltaría la firma del mandatario Carlos Alvarado y la publicación en el Diario Oficial La Gaceta para que entre a regir.
La primera votación obtuvo el apoyo de 33 legisladores mientras 13 votaron en contra estos últimos provenientes de las bancadas de Restauración Nacional, Integración Nacional, Nueva República y la independiente Shirley Díaz.
El proyecto
La iniciativa de ley declararía libre el cultivo, la producción, la industrialización, la comercialización de cáñamo o cannabis no psicoactivo y sus productos o subproductos, para fines alimentarios e industriales, sin autorización previa especial o adicional de las autoridades.
Además, se autorizaría el uso y aprovechamiento en el territorio nacional del cannabis con fines médicos y terapéuticos, única y exclusivamente, para la realización de las siguientes actividades:
La producción, incluyendo la siembra, el cultivo, la cosecha, el almacenamiento, el transporte y distribución, así como la producción y la importación de semilla de variedades de cannabis para:
-Su venta como materia prima a la Caja Costarricense de Seguro Social (CCSS) o a laboratorios o establecimientos debidamente autorizados de conformidad con esta ley para la industrialización, fabricación y comercialización de productos de uso médico o de uso terapéutico en el territorio nacional; o para su exportación a terceros países donde se permite el comercio lícito de estos productos.
-Su industrialización directa por parte de la misma persona productora para la elaboración y comercialización de productos de uso médico o de uso terapéutico, autorizados de conformidad con esta ley. En este caso, la persona productora deberá contar también con el respectivo título habilitante para realizar actividades de industrialización de productos derivados de cannabis de uso médico o terapéutico.
.La elaboración o industrialización, el almacenamiento, el transporte, distribución y la comercialización de medicamentos, cosméticos, aceites esenciales y otros productos de uso médico o de uso terapéutico debidamente autorizados de conformidad con esta ley, a partir de plantas de cannabis sus subproductos y derivados.
.La Caja podrá otorgar contratos de compra de productos a organizaciones, asociaciones, cooperativas o cualquier otro ente que cumpla con lo establecido en la Ley N.° 8262, Ley de Fortalecimiento de las Pequeñas y Medianas Empresas.
Para la realización de las actividades anteriormente indicadas, las personas interesadas requerirán de autorización previa mediante la obtención del respectivo título habilitante otorgado por la autoridad competente, de conformidad con la presente ley. Todas las actividades autorizadas quedarán sometidas al control, la vigilancia, la supervisión y la inspección periódicas del Ministerio de Salud, el Ministerio de Agricultura y Ganadería y el Instituto Costarricense sobre Drogas en el ámbito de sus competencias.
Las licencias para cultivo e industrialización de cannabis con fines médicos o terapéuticos se otorgarán por un plazo de seis años y podrán ser renovadas por periodos iguales, a solicitud del licenciatario y previa demostración de que cumple con todos los requisitos y obligaciones establecidas en la ley y su reglamento. El plazo de los permisos de investigación y el procedimiento para su renovación será regulado en el reglamento de esta ley, según el tipo de investigación de que se trate.
La iniciativa autoriza a la CCSS, en conjunto con las universidades públicas y privadas, a realizar investigaciones y a producir en sus laboratorios medicamentos y productos de uso terapéutico de uso autorizado por el Ministerio de Salud, utilizando cannabis psicoactivo, sus extractos y derivados; así como a recibir, comprar procesar y distribuir cannabis para uso medicinal y terapéutico, sus productos, subproductos y derivados.
Además, se autoriza a la Caja para que, con base en estudios técnicos, incluya medicamentos y productos de uso terapéutico con cannabinoides en sus listas oficiales de medicamentos y a entregarlos a las personas aseguradas, según la prescripción de la persona profesionales en medicina encargada de su tratamiento.
