Sala IV confirma que el MEP lesionó intimidad de estudiantes y familias con pruebas FARO
El Tribunal declaró con lugar 15 recursos de amparo presentados por padres de familia.
La Sala Constitucional declaró con lugar un total de 15 recursos de amparo presentados por padres de familia contra el Ministerio de Educación Pública (MEP) por violar el derecho de miles de estudiantes menores de edad y sus familias a través de la aplicación de ciertas preguntas contenidas en las pruebas de Fortalecimiento de Aprendizajes para la Renovación de Oportunidades (FARO) el pasado 12 de noviembre.
De forma unánime, en la sesión de este viernes 17 de diciembre, el Tribunal concluyó que hubo una “lesión grave y grotesca al derecho a la intimidad”, cobijado en el artículo 24 de la Constitución Política.
Los magistrados concluyeron que la aplicación de las pruebas para obtener datos personales se dio “desde una posición de poder y en contra de una población vulnerable”. Además, afirmaron que los datos fueron obtenidos a través de una prueba obligatoria, impuesta a personas en proceso de formación que requieren de especial protección del Estado en virtud de lo dispuesto en el numeral 3.1 de la Convención sobre los Derechos del Niño y el ordinal 51 de la Constitución Política.
“Se declara con lugar el recurso solo con respecto a la lesión al derecho constitucional a la intimidad, cobijado en el artículo 24 de la Constitución Política. Se ordena a Steven González Cortés, en condición de ministro de Educación Pública, o a quien en su lugar ocupe ese cargo, dictar las medidas correspondientes a los efectos de evitar que se repita la lesión al orden constitucional constatado en el sub lite”, indica el “por tanto” de la resolución.
“Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. En lo demás se declara sin lugar el recurso”, agrega.
Por la aplicación de la polémica prueba, la Sala Constitucional condenó al Estado al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Contexto
El viernes 12 de noviembre anterior el Ministerio de Educación Pública (MEP) aplicó a estudiantes de 5° grado de escuela el cuestionario denominado “Factores Asociados” como parte de las pruebas FARO.
Se trata de cuestionarios de más de 600 ítems en los cuales se le pregunta a los estudiantes por los factores sociales y educativos que podrían afectar su desempeño y resultados en las pruebas FARO.
La controversia surgió por la presencia de preguntas ajenas al campo académico. Por ejemplo, en el capítulo llamado Tronco Común, se les realizaron preguntas sobre el entorno familiar o socioeconómico como el tipo de material del techo, o pisos de la vivienda, los servicios que posee el hogar, los bienes que poseen y si la casa posee espacios exteriores
Según informaron varios padres de familia en redes sociales la ejecución de estos cuestionarios generó un agotamiento extremo en los alumnos quienes duraron hasta cinco horas para contestarlo.
