¿Por qué multaron a un conductor que llevaba un ‘rack’ para bicicletas?
El hecho se dio este lunes en Taras de Cartago.
El uso de ‘racks’ para transportar las bicicletas en el automóvil generó una nueva polémica entre los ciclistas y las autoridades de la Policía de Tránsito este lunes.
Un pedalista de apellido Meneses contó en su perfil de Facebook que fue multado por ese motivo, su queja se volvió viral en minutos.
Los oficiales lo multaron con ₡110 mil por el incumplimento del artículo 122 de la Ley de Tránsito titulado Prohibiciones para la Circulación de Vehículos que reza en el inciso A: “No podrán circular vehículos que cuenten en su estructura carrocería, llantas, aros, aditamientos o elementos punzocortanes que constituyan un ángulo vivo o una protuberancia peligrosa”.
Sin embargo, Meneses, contó al medio CRHoy que en ningún momento el oficial de tránsito le explicó que la razón de la multa era por el “mal acomodo” de las bicicletas y solo hizo referencia a que el ‘rack’ era prohibido y que de hecho la Federación de Ciclismo (Fecoci) era que la había hecho la prohibición. Que el uso del dispositivo solo era permitido en el techo.
El Jefe de la Policía de Tránsito en Montes de Oca, Aarón Mora, confirmó a la revista Bike que la Policía de Tránsito está haciendo multas a quienes lleven las bicicletas en ‘racks’ aplicando el artículo 122. Inciso A de la Ley de Tránsito.
“Buenos días, independientemente que las bicis vayan salidas o no, tránsito nacional ha estado aplicando ese artículo. No es específico para esa situación(rack con bicicleta) pero lo aplican como un elemento que es ajeno a la carrocería del vehículo y que según la interpretación que se da, puede provocar peligro al tener elementos puntiagudos o punzocortantes que quedan al descubierto en la circulación normal del vehículo”, indicó Mora.
