Nuevo Código Procesal de Familia traerá cambios significativos para abogados en Costa Rica
El próximo 1 de octubre marcará un cambio importante en el ámbito legal costarricense con la entrada en vigor del nuevo Código Procesal de Familia. Esta reforma promete transformar la manera en que se manejan los casos de derecho familiar, lo que implicará un incremento notable en la carga de trabajo para los abogados especializados en esta área.
Naín Monge, profesor y vocero del Colegio de Abogados y Abogadas de Costa Rica, explicó que la implementación de la nueva legislación traerá consigo un aumento significativo en la demanda de servicios legales. Según Monge, el nuevo código introduce procesos más técnicos y complejos que exigirán una participación más activa de los abogados para asegurar que se respeten las garantías del debido proceso y el derecho a una defensa adecuada.
Aunque la ley permitirá que las partes en algunos casos de visitas o custodia se presenten sin la representación legal, Monge advierte que muchos de los trámites serán más complicados. “La nueva normativa tiene múltiples etapas que dificultan que una persona sin formación jurídica pueda defenderse eficazmente, especialmente si se enfrenta a una parte que sí cuenta con un abogado”, comentó.
Inquietudes y Desafíos
El Colegio de Abogados ha recibido diversas inquietudes durante el proceso de capacitación sobre el nuevo código. Entre las preocupaciones más destacadas se encuentran las dudas sobre la implementación práctica de la teoría general del proceso, los posibles ajustes legislativos en la Asamblea Legislativa y el manejo de los procedimientos nocturnos de apremio corporal. Monge añadió que la coordinación entre el Ministerio de Justicia y Paz y otras instituciones también plantea desafíos significativos.
Uno de los retos principales es la adaptación a las nuevas tecnologías, ya que el Poder Judicial está integrando sistemas más modernos. Monge destacó la necesidad de capacitar tanto a jueces como a abogados en el uso de estas herramientas tecnológicas para garantizar una transición efectiva.
Perspectivas del Campo
Sofía Cordero, docente de la Facultad de Derecho de la UCR, opina que el nuevo código no será particularmente problemático para los litigantes, pero sí para los jueces, quienes deberán adaptarse a nuevas atribuciones que permiten una mayor dirección del proceso. “La mayor carga de trabajo recaerá en los abogados, quienes deberán familiarizarse con la nueva normativa y con la oralidad de los procedimientos”, explicó Cordero.
José Adrián Granados, abogado en Bufete Granados Asoc., subrayó la necesidad de esperar a ver cómo se aplicará la reforma en la práctica. “Aunque la teoría sugiere que la división de los procesos de familia en cuatro grupos principales y la incorporación de la oralidad aumentarán la necesidad de intervención profesional, solo el tiempo dirá si estos cambios resultan como se espera”, comentó Granados.
