Juzgado cierra causa contra funcionarios municipales y del OIJ, detenidos por el delito de difusión de pornografía
Estas personas fueron detenidas por medio de un allanamiento en el año 2021.
En abril del año 2021, en el país se realizaron una serie de allanamiento los cuales se volvieron bastante mediáticos, debido a que las autoridades en aquel momento dieron con la detención de nueve personas, entre ellos un funcionario del Organismo de Investigación Judicial (OIJ) y dos trabajadores de municipalidades en el Valle Central, esto por estar involucrados aparentemente en el delito de difusión de pornografía.
Sin embargo, según trascendió el Juzgado Penal del I Circuito Judicial dictó un sobreseimiento definitivo y puso fin a una causa penal contra los nueves sospechosos investigados, esto en la resolución que fue dictada el pasado 31 de enero de este año.
“Se considera que se debe de proceder a dictar el sobreseimiento definitivo por cuanto no existen bases para elevar a juicio según los argumentos que constan en el audio de la resolución. Firme esta sentencia, procédase al levantamiento de cualquier medida cautelar que se hubiere ordenado. Quedan los gastos del Proceso Penal a cargo del Estado”, indica la resolución judicial.
Dicho documento indica que el sobreseimiento definitivo se determina debido a los siguientes escenarios:
- El hecho denunciado no se realizó o no fue cometido por el imputado.
- El hecho no esté adecuado a una figura penal.
- Medie una causa de justificación de inculpabilidad.
- La acción penal se ha extinguido.
- A pesar de la falta de certeza, no exista razonablemente la posibilidad de incorporar nuevos elementos de prueba y no hay bases para requerir fundadamente la apertura a juicio.
En cuanto a los nueve detenidos que ya fueron absueltos, estos fueron identificados con los apellidos Herrera Samudio, Lobo Quesada, Rivera Durán, Sánchez Ramírez, González García (empleado judicial), Fonseca Rojas (empleado municipal), Venegas Miranda (empleado municipal), Montero Hidalgo y Bonilla Delgado.
Los allanamientos se habían realizado en los sectores de Aserrí, Alajuela, Cartago, Heredia, Parrita y San Francisco de Dos Ríos.
