Hombre denuncia que le decomisaron $800mil en el aeropuerto y que las autoridades reportaron $156mil menos
Este caso ocurrió en noviembre del 2019 y la sentencia fue dictada a finales del 2022.
En noviembre del 2019, se dio el decomiso de $800 mil en efectivo a un hombre de apellido Santamaría, en el aeropuerto internacional Juan Santamaría, y ahora que el fallo judicial quedó en firme a finales del 2022, el dueño del dinero alega que las autoridades reportaron $156 mil menos.
Esto después de que el Juzgado Penal de Alajuela dictó un sobreseimiento definitivo contra el dueño de dicho dinero, el cual fue decomisado a unos custodios que se presentaron a la oficina de Aduanas del aeropuerto para declarar que llevaban el dinero en efectivo.
Según comentó el abogado, en Estados Unidos se realizó la declaración del dinero, y en el país también, asimismo, cuestionó el acta de apertura de evidencia que se redactó en un cuaderno que indica un conteo de fajos de dinero y no el de billetes específicos que se realizó varias horas después del decomiso.
“Consideramos que en ese momento hubo una aparente violación al procedimiento que maneja la Fiscalía y la Policía de Control de Drogas… Hemos consultado con la Fiscalía, pero creemos que no le dieron importancia debida porque lo que esta semana presentaremos una denuncia formal”, expresó.
En cuanto al caso que se le seguía al empresario Santamaría, el Ministerio Público solicitó un sobreseimiento definitivo, y este fue acogido por el Juzgado, ya que alegaron que no se podía probar que el dinero tuviera un origen de una actividad delictiva.
Ante dicho proceso abierto, Brenes, alega que la Fiscalía había determinado que el dueño del dinero era Santamaría y sus empresas, por lo que ha solicitado que se excluya a los estadounidenses de la causa, ya que se demostró que él es la persona dueña del dinero y por ende, la persona que debería ser demanda.
Con respecto al dinero en cuestión, este permanece en las cuentas del Instituto Costarricense sobre Drogas (ICD).
