Cámara de Comercio: “Impuesto al ‘Vapeo’ detonará el mercado ilícito”
Los diputados aprobaron en primer debate el impuesto del 20 % a los vapeadores y accesorios para el vapeo. La iniciativa genera controversia.
El lunes anterior 25 diputados de la República aprobaron, en su trámite de primer debate, el proyecto de ley 21.658 que busca crear un impuesto del 20 % tanto a los vapeadores como a todos los accesorios para esta actividad.
El proyecto indica que el dinero recaudado se destinará para que la Caja Costarricense de Seguro Social (CCSS) lo destine en la compra de medicamentos que se requieren para tratar las enfermedades que provoca el consumo de estos productos.
Esta iniciativa ha generado controversia. La diputada del Partido Unidad Social Cristiana (PUSC), María Inés Solís, aseguró que de aprobarse propiciará un mercado informal que fomentará el consumo del cigarrillo tradicional.
Por su parte el presidente del Partido Unión Liberal, Otto Guevara Guth, se manifestó en contra de la iniciativa en sus redes sociales y aseguró que bajar impuestos ayuda a aumentar la recaudación.
“Los diputados están muy prontos a aprobar un proyecto de ley tiene que ver con el vapeo, con los vaporizadores y los productos que se utilizan para vaporizar. Vienen nada menos y nada más con impuesto del 20 % para los aparatos, los vaporizadores, que esos aparatos valen algunos más de 100 mil colones”, manifestó Guevara.
“Entonces le pretenden meter un impuesto del 20 % y todos los repuestos, las esencias y todo lo de más otro 20 % a todo lo que le echan al producto del vaporizador para vaporizarlo. Pareciera que el impuesto viene con los semáforos en verde con el propósito de ser aprobado en las próximas semanas”, añadió
El presidente de Unión Liberal agregó: “Espero que los diputados cumplan con ese compromiso que asumieron con sus electores con Costa Rica diciendo, ¡no más impuestos! Y que rechacen los que vienen contenidos en el proyecto del impuesto a los vapeadores y a todos los productos que se utilizan para vapear. Yo espero que ellos recapaciten y le digan no a esos nuevos impuestos, estamos hasta la coronilla de impuestos”.
“Cuando usted logra bajar impuestos usted logra inclusive aumentar la recaudación. Hay un montón de estudios que demuestran eso entre menos impuestos hay más recaudación hay porque menos incentivos hay para la evasión, el contrabando, etc”, acotó el exdiputado.
Una posición similar tiene el Observatorio de Comercio Ilícito (OBCI) de la Cámara de Comercio de Costa Rica (CCCR).
“Esta tasa del 20% continúa siendo una tasa muy alta y confiscatoria. La experiencia internacional lo ha demostrado, las altas tasas impositivas aplicadas a los productos de vapor en países como Portugal y Hungría tuvieron un impacto negativo en el mercado local y finalmente fueron abandonadas, por lo que nuestra recomendación es disminuir la tasa impositiva al 5 % para los aparatos electrónicos y 15 % para los líquidos”, indicó Jairo Mena, Director Ejecutivo del Observatorio del Comercio Ilícito de la CCCR en un comunicado de prensa.
De acuerdo con la entidad, aplicar un impuesto excesivo o confiscatorio al consumo de los sistemas electrónicos de administración de nicotina y sistemas similares sin nicotina, encarecerá y se hará menos atractivo para los consumidores adultos, aumentará el comercio ilícito y limitará el crecimiento futuro de la categoría arancelaria.
Para el 2019 el comercio ilícito en el país, superó los 700 mil millones de colones, monto equivalente al 2 % del Producto Interno Bruto del país (PIB), según datos estimados por el OBCI. Siete de cada cien colones devengados por las familias costarricenses, fueron destinados a productos transados fuera del mercado legal.
“Esta cifra se agrava cuando se analiza por separado el mercado ilícito de los cigarrillos, producto que presentaría un comportamiento similar al que pretende regular este expediente. Según estimaciones de la industria, actualmente, más del 40 % del consumo de cigarros en el país proviene del mercado ilícito, lo que evidentemente pone en riesgo la salud e integridad física de los adultos que acuden al mercado ilícito, con el fin de ahorrarse dinero”, agrega el boletín de prensa.
El mercado ilegal de cigarrillos en el país, es consecuencia de las elevadas cargas impositivas que tiene este producto, generando altos incentivos para un mercado informal, que además de los riesgos de salud antes señalados, también implica un incremento en la inseguridad ciudadana, producto de las redes delictivas detrás de la comercialización de estos productos.
Otras de las consecuencias del comercio ilícito y la informalidad son la pérdida fiscal y recaudaciones sociales. Para el 2019, la Hacienda Pública perdió más de 77.000 millones de colones por el mercado ilícito y la C.C.S.S. dejó de percibir más de 680.000 millones de colones por año a causa de la informalidad.
“Bajo este escenario, desde el Observatorio del Comercio Ilícito recomendamos que todos los dispositivos electrónicos de vapeo y calentado, no sean sujetos al impuesto, para que su valor no se incremente súbitamente y se incentive el mercado ilícito de éstos. Esta medida no representará un cambio significativo en el consumo, ni en la recaudación. Los dispositivos electrónicos se adquieren, en muchos casos una única vez por los consumidores. La base impositiva se debe centrar en los “líquidos de vapeo”, agregó Mena.
