Albino Vargas: “El proyecto Marco de Empleo Público está políticamente muerto”
Líder de la ANEP hizo un llamado a protesta para que el texto se “entierre por completo”.
El secretario general de la Asociación Nacional de Empleados Públicos y Privados (ANEP), Albino Vargas, reaccionó ante la resolución de la Sala Constitucional y considera que el proyecto de ley de empleo público está muerto.
La Sala IV resolvió la noche del sábado anterior las consultas de constitucionalidades que fueron presentadas contra la Ley Marco de Empleo Público. Encontró 35 inconstitucionalidades de fondo tras las consultas facultativas solicitadas por los diputados.
“Decirle a toda la clase trabajadora del empleo público y todas las amistades cívicas y populares que están en la lucha social que el proyecto Marco de Empleo Público está políticamente muerto. La Sala IV ha respetado los valores fundamentales de la Constitución del 49 en cuanto a las autonomías del Poder Judicial, del Tribunal Supremo de Elecciones, de la Caja, de las municipalidades, de las universidades públicas y en cuanto a toda la temática de los derechos laborales económicos y sociales”, aseguró el líder sindical.
“Recuerden que todo eso contrasta, choca, colisiona con los contenidos de lo que acaba de darse a conocer en el país la opinión consultiva de la Corte Interamericana de Derechos Humanos (CIDH) y todo eso se va a caer”, agregó.
“Hay que enterrar el proyecto, tenemos que salir a las calles a enterrarlo ahora que está políticamente muerto en una gran unidad social y popular. Vamos a enterrarlo como vamos a enterrar la ley antihuelgas y como la ley del combo fiscal se va a caer”, finalizó.
Los magistrados encontraron vicios en los artículos del proyecto que daban la rectoría al Ministerio de Planificación sobre universidades públicas, municipalidades, la Caja Costarricense de Seguro Social (CCSS) y el Tribunal Supremo de Elecciones que gozan de autonomía.
Son subsanables
Por medio de un comunicado de prensa, el Poder Ejecutivo aseguró que los señalamientos de la Sala Constitucional al proyecto son subsanables.
“El pronunciamiento de la Sala Constitucional deja claro que la Ley Marco de Empleo Público no contiene ninguna inconstitucionalidad en su tramitación y además avala la fijación del salario único global y las limitaciones a las convenciones colectivas”, indicó Presidencia en un escueto boletín.
“Estos son los elementos centrales para generar un ahorro sustancial, pero sobre todo razonabilidad y justicia en las remuneraciones a lo interno del sector público, así como entre éste y el sector privado. Habrá que hacer algunas correcciones técnicas, para ajustar el texto a lo señalado por la Sala, pero todas son factibles y pronto la ley marco de empleo público será una realidad”, agregó el documento.
