Adiós a la Cárcel para Mayores de 65 Años por Deudas de Pensión Alimentaria: Nueva Reforma Entra en Vigor
A partir del 1 de octubre, los adultos mayores de 65 años dejarán de ser encarcelados por deudas de pensión alimentaria, según la nueva reforma al Código Procesal de Familia. Esta medida marcará un cambio significativo en la forma en que se manejan las obligaciones alimentarias para esta población vulnerable.
Cambios Clave en la Legislación
El artículo 283 de la reforma estipula que a partir de octubre, los mayores de 65 años no enfrentarán prisión por no cumplir con el pago de pensiones alimentarias. En lugar de ello, se buscarán alternativas como el embargo de bienes para recuperar las deudas. Esta reforma ha sido ampliamente discutida y se considera un avance en la protección de los derechos de los adultos mayores.
Gilbert Gómez, exjuez de familia, aplaudió la medida como un triunfo para la justicia. Según Gómez, el enfoque del nuevo sistema es más acorde con la realidad de los adultos mayores, quienes, en su opinión, deberían recibir pensiones de sus nietos y bisnietos en lugar de ser encarcelados. La reforma se percibe como una respuesta a años de lucha por una legislación más humana y justa.
Excepciones y Procedimientos
El nuevo marco legal excluye a los adultos mayores de 65 años del apremio corporal, que anteriormente podía durar hasta seis meses. En su lugar, se utilizarán métodos de cobro como el embargo de cuentas y bienes. Además, se introducen excepciones para personas en estado avanzado de embarazo o con condiciones de salud graves que podrían verse perjudicadas por el apremio corporal.
Maureen Solís, jueza de familia, destacó que la Ley de Pensiones Alimentarias carecía de regulación clara, lo que complicaba la aplicación de la ley. Aunque la nueva regulación ofrece más claridad, Solís reconoció que aún existen algunos aspectos confusos y limitaciones en la ley, especialmente en lo que respecta al cobro de pensiones impagas.
Impacto en los Deudores y Proceso de Cobro
A partir de la implementación de la reforma, las personas mayores de 65 años que no cumplan con sus obligaciones alimentarias serán objeto de embargos en lugar de encarcelamiento. El proceso de cobro seguirá un procedimiento denominado «título ejecutorio», regulado por el Código Procesal de Familia, y se enfocará en embargar bienes en lugar de recurrir a la prisión.
Hasta el momento, el Ministerio de Justicia y Paz ha indicado que no hay registros de deudores mayores de 65 años actualmente encarcelados por deudas alimentarias. Sin embargo, a partir del 1 de octubre, cualquier adulto mayor detenido bajo esta figura deberá ser liberado.
