Según los especialistas legales, la trágica pérdida de la bebé Isabella del Milagro implica consecuencias legales para los médicos encargados de su tratamiento, con la posibilidad de enfrentar penas de hasta 10 años de prisión.
Además, se plantea una corresponsabilidad por parte de la Caja Costarricense de Seguro Social (CCSS) en relación con el fallecimiento de la pequeña.
“Podíamos establecer que exista responsabilidad de todas las personas dentro del centro médico que omitieron o que no realizaron lo que se debió haber realizado para otorgarle la debida atención a la menor que nace en estado de prematuridad y que requería de un servicio. Igualmente el trato que se le da a su madre es considerado inhumano y que está calificado como violencia obstétrica ”, explicó el abogado penalista Rafael Rodriguez a Noticias Repretel.
La niña nació el pasado 9 de enero en el Hospital de Nicoya. Angie Herrera, madre de la menor, denunció públicamente que personal de ese centro médico le negó atención médica a su bebé, quien nació con apenas 26 semanas.
Luego, la pequeña fue trasladada al Hospital de Puntarenas y pese a los esfuerzos por mantenerla con vida las 18 horas primarias donde no la mantuvieron en incubadora fueron claves.
“Producto de ese desamparo físico, producto de esa vulnerabilidad coloca al autor dentro de la posibilidad de ir a prisión de 6 a 10 años por eso considero que estamos en presencia de un abandono de incapaz. Esta conducta dolosa por parte de los funcionarios que generó la muerte hace también responsable a la institución desde el punto de vista civil”, explicó el abogado Rodrigo Rosales al noticiero de canal 6.
La niña fue sepultada el pasado domingo 14 de enero en el cementerio de Los Ángeles en Tilarán, Guanacaste.
