Francia creará un ‘delito de ecocidio’ con condenas de hasta diez años de cárcel
Las multas, que buscan sancionar los daños graves al medio ambiente, oscilarán entre 444.000 y 5,4 millones de dólares. También establecerán un delito por poner en peligro a la naturaleza.
El Gobierno de Francia comunicó este domingo 22 de noviembre que establecerá un ‘delito de ecocidio’ para prevenir y castigar los daños graves que se provoquen al medio ambiente, que deriva de una iniciativa de la Convención Ciudadana por el Clima.
En diálogo con el semanario Journal du Dimanche, Eric Dupond-Moretti, ministro francés de Justicia, comentó: “A día de hoy hay quienes optan por contaminar, porque les cuesta menos que limpiar. Esto va a cambiar (…). Espero que seamos sumamente disuasivos”. Y destacó: “Antes, contaminamos: no pagábamos. Ahora, contaminamos: pagamos diez veces más de lo que pensábamos ahorrar”.
Cabe mencionar que la Convención Ciudadana por el Clima, que congrega a 150 ciudadanos seleccionados al azar para que propongan opciones para disminuir las emisiones de gases de efecto invernadero, solicitaba crear un crimen y no un delito como anuncia el Gobierno.
“Al entusiasmo ciudadano expresado debe sucederle una traducción jurídica en el código penal”, alegó Moretti, señalando un inconveniente de constitucionalidad respecto a la expresión “crimen”.
“Las condenas van de tres a diez años de cárcel, según se trate de una infracción de imprudencia, una violación manifiestamente deliberada de una obligación o, la más alta, una infracción intencionada”, precisó el alto funcionario.
Quienes provoquen graves perjuicios contra el medio ambiente tendrán que pagar multas, las cuales buscan ser disuasivas, que fluctúan entre 375.000 euros y 4,5 millones (444.000 a 5,4 millones de dólares).
También se instaurará un segundo delito de “poner en peligro al medio ambiente”. A diferencia del primero, las penalidades podrán aplicarse incluso cuando la contaminación todavía no ha tenido lugar, manifestó la ministra de Transición Ecológica, Barbara Pompili, a AFP.
La sentencia será de un año de prisión y 100.000 euros (118.000 dólares) de multa.
Los titulares del Ministerio de Justicia y de Medio ambiente se reunirán por sesión virtual el lunes con representantes de los 150 ciudadanos de la Convención por el Clima, que fue fundada en octubre de 2019 a propuesta del mandatario de Francia, Emmanuel Macron.
