Limón Fútbol Club no pierde la esperanza de mantenerse en la Primera División
El campeonato de Clausura de 2021 de la Primera División se jugará con 12 equipos.
El equipo de Limón FC mantiene esperanzas de poder seguir en la primera división y este viernes informó que acudió al Tribunal de Apelaciones de la Federación Costarricense de Fútbol.
Los caribeños ya habían pedido la nulidad de la última temporada de la Liga Promerica y fue negada por parte del Consejo Director y Comité de Competición de la Unafut.
Como parte del proceso de apelación que inició Limón FC, esta semana se presentó ante el Tribunal de Apelaciones de la Federación Costarricense de Fútbol (FEDEFUTBOL) un Recurso de Apelación por Inadmisión.
De esta manera queremos ratificar, que pese a las decisiones inexplicables que ha tomado el Consejo Director de Unafut, Limón, como se dijo desde el inicio del proceso, llevará este caso a todas las instancias que sean necesarias.
El Licenciado Luis Zúñiga Portilla, quien encabeza el grupo de abogados que están llevando el caso, expresó que mantienen la credibilidad en el proceso y que aunque las resoluciones en la Unafut no fueron favorables, sabe que la independencia del Tribunal de Apelaciones de la Fedefutbol le dará la razón a Limón FC.
“Se debe respetar el marco jurídico, hay pasos que se deben cumplir y no se podía llegar al Tribunal de Apelaciones sin agotar la vía en la Unafut. El caso es muy claro y nuestra apelación no deja espacio a dudas. El final feliz de este caso está cada vez más cercano, la justicia prevalecerá”, expresó Zúñiga Portilla.
En la argumentación de Limón FC se deja muy claro que el Consejo Director de la UNAFUT, presidido por Julián Solano, quiere inducir a error a las instancias superiores, y a la opinión pública en general, y trata de desconocer la naturaleza de la impugnación realizada y de vedar la posibilidad de que Limón continúe ejerciendo los recursos pertinentes, pero peor aún, violentando flagrantemente el principio constitucional de doble instancia.
“No estamos en presencia de simplemente materia competitiva, no solo se ejercieron los recursos pertinentes correspondientes, sino que se ejerció una nulidad en contra de las asambleas realizadas, siendo que la nulidad y procedimiento no se encuentra establecido ni regulado en los estatutos de UNAFUT”, detalla el Recurso.
Zúñiga Portilla aseguró que se le solicita al Tribunal de apelaciones como contralor de legalidad, que revoque y anule la resolución del Consejo Director, se admita el recurso de apelación en efecto suspensivo, y se emplace a las partes para la expresión de agravios, conforme en derecho corresponda.
