Josué Quesada presenta recurso de amparo contra veto de Alajuelense
El periodista de Tigo Sports acudió a la Sala Constitucional para defender su libertad de prensa.
Josué Quesada, el controvertido periodista de Tigo Sports, emprendió acciones legales en respuesta al veto impuesto por Liga Deportiva Alajuelense (LDA), el cual fue anunciado el jueves 21 de agosto, prohibiéndole la entrada al estadio Alejandro Morera Soto.
El comunicador, que ha cubierto eventos deportivos durante años, presentó un recurso de amparo ante la Sala Constitucional con el objetivo de revertir la medida tomada por el cuadro rojinegro. Esta drástica acción por parte de Alajuelense fue resultado de un incidente en el que Quesada publicó un video en el que criticaba al jugador manudo, Joel Campbell.
“Existen otros casos similares que la Sala Constitucional ha marcado el estándar de que, para que sean aceptables las limitaciones de la libertad de expresión e información, por las opiniones tanto de hinchas como de periodistas, las sanciones deben ser proporcionadas, respetar el debido proceso y resguardar el derecho de defensa”, explicó David Delgado, abogado de Más Legal Asesores al periódico La Nación.
El asesor legal indicó que el recurso de amparo se presentó este martes 26 de setiembre.
“La Sala Constitucional ya ha marcado la línea en cuanto a las sanciones indefinidas y la necesidad de adecuarlas a un parámetro mínimo y un máximo para considerarlas como constitucionales. La decisión comunicada por Alajuelense emite una sanción a perpetuidad al periodista, por lo cual dicha actuación se debe reputar como inconstitucional”, agregó el bufete.
