Las investigaciones en torno a los escándalos que han sucedido durante su administración sugieren, según especialistas, que el presidente de Estados Unidos, Donald Trump, puede enfrentar procesos penales si no llega a ser reelegido para un segundo mandato en las elecciones presidenciales.
Hasta el momento, frente a la posibilidad de una investigación criminal contra del republicano, lo protege la inmunidad que le otorga su puesto. Los jefes de Estado en ejercicio no pueden ser llevados ante el tribunal. Lo que lleva a la evidente cuestión: ¿Qué pasará si sale de la Casa Blanca?
En diálogo con BBC Mundo, Bennett Gershman, catedrático de derecho constitucional en la Universidad de Pace, quien se desempeñó por diez años como fiscal en el estado de Nueva York, dijo: ‘’Creo que hay la posibilidad de que se le imputen cargos criminales a Trump’’.
‘’Los cargos que el presidente podría enfrentar tienen que ver con fraude bancario, fraude de impuestos, lavado de dinero, fraude electoral”, entre otros, afirmó Gershman, indicando “toda la información que ha salido a la luz en los medios sobre su conducta financiera’’.
El diario The New York Times informó que en los próximos cuatro años Trump tiene que pagar más de 300 millones de dólares en préstamos, en momentos en que algunas de sus inversiones personales no pasan por una buena temporada.
Y si el presidente no consigue el triunfo en los comicios presidenciales, tal vez sus acreedores sean menos flexibles a la hora de exigir la retribución de esas obligaciones, explicó el medio británico.
El académico sostuvo que cabe suponer que pueda haber otros cargos por obstrucción a la justicia “a partir de los resultados del llamado informe Mueller, que averiguó las acusaciones de interferencia de Rusia en la campaña presidencial estadounidense de 2016”.
En 2019, el fiscal especial Robert Mueller entregó el reporte, el cual no encontró prueba concluyente de que la campaña del entonces candidato Trump estuviera deliberadamente colaborando con el Gobierno ruso; no obstante, el informe documentó una serie de actuaciones controversiales del mandatario en respuesta a esta indagación.
Por su parte, el actual residente de la Casa Blanca afirmó haber sido víctima de numerosas conspiraciones por parte de sus enemigos para acusarlo falsamente de haber perpetrado crímenes antes y durante su estadía en el poder.
Asimismo, destacó que ha salido airoso de las investigaciones que realizó el Departamento de Justicia en torno a los numerosos escándalos que han enmarcado su gestión, así como del juicio político que le desarrolló el Congreso a inicios de este año.
Si fuera encontrado culpable por cargos como los que se han discutido, Donald Trump podría enfrentar una condena “de años, no de meses” en la cárcel, advirtió Gershman. “La ley aplica para todos”, señaló.
