Diputado presenta acción de desobediencia contra Gobierno por falta de información sobre contrato con BCIE
El diputado Ariel Robles Barrantes, del Partido Frente Amplio (FA), ha presentado una acción de desobediencia en contra del despacho del presidente Rodrigo Chaves. La solicitud fue interpuesta ante la Sala Constitucional tras el incumplimiento de una orden que exigía la entrega de información sobre un contrato entre el Banco Centroamericano de Integración Económica (BCIE) y una empresa relacionada con el productor audiovisual Christian Bulgarelli.
El caso del contrato
El origen de esta situación se remonta a una contratación realizada por el Sistema Nacional de Radio y Televisión (Sinart), donde la empresa RMC La Productora S.A., propiedad de Bulgarelli, fue seleccionada como proveedora de servicios. Lo que genera controversia es que Bulgarelli, además de ser asesor de Casa Presidencial, participó en el diseño de la contratación, lo que terminó beneficiando a su propia empresa. El financiamiento de estos servicios provino de una donación del BCIE a Costa Rica.
Se ha señalado que el propio Bulgarelli, junto con Federico «Choreco» Cruz, exasesor presidencial, habría redactado los términos del contrato, lo que levanta sospechas sobre un posible conflicto de interés al haber ganado la misma empresa que estableció las condiciones.
El incumplimiento del Gobierno
A raíz de estos hechos, se le ordenó en febrero al jefe de despacho del presidente Chaves, Gabriel Aguilar Vargas, entregar una copia del contrato y detallar los nombres de los funcionarios que estuvieron involucrados. Aunque se envió un correo con parte de la información solicitada, Robles denunció que el documento estaba incompleto y no incluía los nombres requeridos. Además, no aclaraba si el dinero proveniente del contrato ingresó a las arcas del Estado, como habían solicitado los magistrados.
Nueva solicitud ante la Sala Constitucional
Ante la falta de cumplimiento, el diputado Robles ha solicitado que la Sala Constitucional acoja la acción de desobediencia, declarando el incumplimiento absoluto de la orden y exigiendo nuevamente que Aguilar entregue la información completa. Robles sostiene que el Gobierno no ha cumplido con las obligaciones impuestas por el tribunal constitucional, lo que justifica la acción legal presentada.
