Proyecto que busca seguimiento a condenados por violación genera debate en la Corte
El proyecto de ley 24.327, que propone la creación de un Banco de Material Genético y el seguimiento a delincuentes sexuales, ha desatado preocupación dentro del Poder Judicial. A pesar de sus intenciones, el impacto que podría tener en la organización y funcionamiento de la institución es motivo de discusión.
Preocupaciones dentro del Poder Judicial
La magistrada Sandra Zúñiga, de la Sala de Casación Penal, expresó que aunque el proyecto busca disuadir a los agresores sexuales y mejorar el control sobre ellos, algunos de sus aspectos pueden ser polémicos. Uno de los puntos más sensibles es la idea de que el material genético de los condenados actúe como un mecanismo preventivo. Zúñiga señaló que las disposiciones del proyecto podrían afectar derechos fundamentales, además de utilizar terminología imprecisa.
Otro de los puntos de controversia es que el proyecto no distingue entre adultos y menores de edad cuando se trata de la recolección de material genético. Asimismo, Zúñiga destacó que asignar al Organismo de Investigación Judicial (OIJ) la tarea de reinserción social de los condenados excede sus competencias tradicionales.
Dificultades para la implementación
Randall Zúñiga, director del OIJ, a pesar de las dificultades que el proyecto podría generar en términos de recursos, apoya la iniciativa. Según él, la medida es crucial para hacer justicia a las víctimas de agresiones sexuales, destacando la importancia de poder localizar rápidamente a los agresores.
Por su parte, la magistrada Roxana Chacón recordó que anualmente se reciben alrededor de 14.000 denuncias por delitos sexuales, pero solo entre 180 y 200 terminan en condena. Chacón cuestionó que el OIJ sea responsable de la reinserción social, sugiriendo que su rol debería limitarse al seguimiento de los sentenciados.
Una visión diferente
No todos en la Corte comparten las preocupaciones. Iris Rocío Rojas, magistrada de la Sala Primera, considera que el proyecto no afectaría el funcionamiento del Poder Judicial, ya que el seguimiento se centraría en aspectos científicos, similares a los que ya se manejan en el sistema CODIS (Sistema Combinado de Índices de ADN).
Reacciones políticas
María Marta Carballo, diputada del Partido Unidad Social Cristiana y promotora del proyecto, defendió la iniciativa asegurando que se diseñó en conjunto con el director del OIJ. Además, mencionó que, en caso de ser necesario, se buscaría financiamiento adicional para implementar el Banco Genético, resaltando la urgencia de abordar este tema.
Carballo destacó que uno de los aspectos innovadores del proyecto es la coordinación entre varias instituciones para mejorar la reinserción social de los ofensores sexuales, bajo la supervisión del OIJ.
