La Corte Internacional de Justicia (CIJ) ha emitido un fallo histórico este viernes, declarando que la ocupación israelí de los territorios palestinos, que ha perdurado durante décadas, es «ilegal». Este tribunal, con sede en La Haya, ha instado a Israel a poner fin a esta situación «lo más rápidamente posible».
Contexto del Fallo
La CIJ, el principal órgano judicial de la ONU, se pronunció sobre las implicaciones legales de la ocupación israelí de los territorios palestinos desde 1967, en un contexto de creciente tensión y más de nueve meses de conflicto en Gaza. «La continua presencia de Israel en los Territorios Palestinos es ilegal», declaró Nawaf Salam, presidente del tribunal, después de considerar testimonios de medio centenar de países.
Consecuencias de la Decisión
El tribunal indicó que Israel tiene la obligación de cesar su presencia en los territorios ocupados «lo antes posible». Esta decisión se tomó después de que la Asamblea General de la ONU aprobara, el 31 de diciembre de 2022, una resolución solicitando una «opinión consultativa» sobre las consecuencias jurídicas de las políticas y prácticas de Israel en los territorios palestinos, incluyendo Jerusalén Este.
Reacciones Internacionales
El primer ministro israelí, Benjamin Netanyahu, reaccionó con desdén, calificando el fallo como una «mentira». En un comunicado, Netanyahu afirmó que «el pueblo judío no es ocupante en su propia tierra ni en nuestra capital eterna, Jerusalén, ni en nuestro patrimonio ancestral de Judea y Samaria», en referencia a Cisjordania ocupada. Afirmó que «ninguna decisión basada en mentiras en La Haya distorsionará esta verdad histórica».
Por otro lado, la Autoridad Palestina, liderada por Mahmud Abás, celebró la decisión como un «gran día para Palestina». Abás instó a la comunidad internacional a presionar a Israel para que cumpla con la resolución de la CIJ. La ministra delegada de Relaciones Exteriores de la Autoridad Palestina, Varsen Aghabekian Shahin, destacó la importancia histórica y legal de este fallo.
Antecedentes Históricos
La disputa territorial se remonta a la Guerra de los Seis Días en junio de 1967, cuando Israel capturó Cisjordania y Jerusalén Este de Jordania, los Altos del Golán de Siria, y la Franja de Gaza y el Sinaí de Egipto. Desde entonces, Israel ha mantenido la ocupación de estos territorios, una situación que la ONU ha declarado ilegal.
