Sentenciados con libertad condicional volverán a prisión si cometen otro delito
“Ley para revocar o modificar el beneficio de libertad condicional al condenado que sea arrestado en el disfrute del beneficio” fue aprobada en segundo debate este martes.
Con el respaldo de 39 diputados, se aprobó en segundo debate el expediente 23.519, conocido como la “Ley para revocar o modificar el beneficio de libertad condicional al condenado que sea arrestado en el disfrute del beneficio”.
Entre los votos en contra, destacan las diputadas de Nueva República, Gloria Navas y Dinorah Barquero del Partido Liberación Nacional (PLN).
El proyecto, presentado por la diputada del Partido Unidad Social Cristiana (PUSC), María Marta Carballo, añade un inciso al artículo 67 del Código Penal, con el fin de establecer claramente que, en caso de que una persona beneficiaria de libertad condicional sea arrestada por cualquier autoridad policial bajo sospecha de cometer un delito doloso, ya sea en flagrancia o durante el transcurso de una investigación judicial, perderá automáticamente dicho beneficio y será remitida a prisión.
Según la reforma propuesta, la autoridad policial responsable de efectuar el arresto tendrá la obligación de informar de manera inmediata al Ministerio Público y al juez competente sobre la detención realizada.
La iniciativa surge como respuesta al trágico asesinato de Keylor Gamboa en diciembre de 2022, durante un robo en Zapote, en el cual perdió la vida junto a su novia.
El culpable del homicidio poseía una sentencia previa y disfrutaba de libertad condicional, a pesar de haber sido detenido en múltiples ocasiones antes del trágico incidente.
“Este proyecto lo motivó la lamentable noticia de Keylor Gamboa. A este joven lo asesinó una persona que tenía condena en firme y que gozaba de beneficio carcelario. Además, lo habían arrestado 30 veces y nada pasó. Eso no se puede seguir dando”, explicó Carballo.
Tras su aprobación, el proyecto pasará al Poder Ejecutivo para que el presidente de la República, Rodrigo Chaves, lo firme.
