El diputado del Frente Amplio, Jonathan Acuña Soto, celebró que la Sala IV declaró inconstitucional el proyecto de jornadas 4×3 por vicios de procedimiento.
Con cinco votos de siete la Sala Constitucional de la Corte Suprema de Justicia (conocida popularmente como Sala IV) determinó que el proyecto de ley 21.182 que pretendía instaurar en el país las jornadas 4×3 (trabajar por 12 horas durante cuatro días a cambio de tres de descanso) presenta un “vicio sustancial de constitucionalidad en el procedimiento legislativo al haberse reasignado el proyecto de ley a otra comisión legislativa”.
Por lo tanto, fue declarado como inconstitucional y se devolverá a su estudio en comisión para una nueva tramitación.
“Esa porquería de proyecto de ley que buscaba hacer retroceder este país en materia de derechos laborales, está muerto. En buena hora, el proyecto de jornadas de 12 horas está muerto. Se cayó en la Sala por procedimiento”, indicó Acuña.
“Los derechos laborales de este país se consiguieron a partir de luchas y los derechos laborales de este país se defienden a partir de luchas una y otra vez. En buena hora, costarricenses, los derechos laborales de este país no retrocedieron al siglo XVIII, ni al siglo XIX. En buena hora, se cayó por procedimiento, ese proyecto está muerto al día de hoy, así que a celebrar que está muerto ese retroceso en materia de derechos laborales. En buena hora, diputados y diputadas, en buena hora, pueblo de Costa Rica”, agregó.
“Así, como hemos defendido una y otra vez los derechos laborales, frente a intereses muy pequeños que no comprenden, que no quieren comprender, que no se alcance a desarrollo económico pasándole por encima los derechos de la gente más vulnerable”, manifestó.
Acuña insistió en que “así como una y otra vez hemos buscado que bajo ninguna condición nos vendan la idea de que es digno que alguien tenga que romperse la espalda por muchas veces salarios de hambre, en jornadas extensísimas, como si este país se trasladara de nuevo a ese siglo XVIII, cuando no existían ni derechos laborales”.
El frenteamplista indicó: “Así como lo hemos hecho una y otra vez, vamos a seguir haciéndolo. En buena hora y agradecer a las diputadas y diputados que se sumaron a hacer consultas a la Sala Constitucional, no solo a mi fracción, también a otras fracciones que se sumaron a hacer esa consulta”.
“En buena hora, diputadas y diputados, agradecer esa postura patriótica, esa postura patriótica de defender los derechos de las personas trabajadoras en este país”, dijo.
“Quisieron pasar una aplanadora, y lo dijimos en su momento, la aplanadora de las vías rápidas, de evitar la discusión de fondo, porque había mucho apuro, mucho apuro en hacer retroceder los derechos laborales de la gente”, finalizó.
