Brasil determina que la homotransfobia es un delito de injuria racial y lo castigará con cárcel
Quienes incurran en este delito podrán ser condenados hasta con cinco años en una prisión y no tendrán derecho a pagar fianza. La decisión fue tomada en la Corte Suprema de Brasil, con nueve votos a favor y solo uno en contra.
El Supremo Tribunal Federal (STF) de Brasil equiparó la homotransfobia con la injuria racial, a su vez contemplada como racismo, un delito que no permite el pago de fianza y tampoco prescribe.
La Corte Suprema corrigió así una interpretación que retiraba parte de la aplicabilidad de la ley sobre injuria racial, sancionada en enero pasado por el presidente de Brasil, Luiz Inácio Lula da Silva, en una de sus primeras acciones desde que asumió su tercer mandato.
Así, los responsables en ofender la honra de una persona por su género u orientación sexual serán procesados de la misma forma que los que discriminan por raza, color, etnia, religión u origen.
La ley de injuria racial, aprobada en diciembre por el Congreso y sancionada este año por Lula, elevó las penas de entre uno y tres años a entre dos y cinco años de reclusión.
Además, con la nueva legislación, los condenados por injuria racial en los estadios estarán impedidos de ir a estos durante tres años después de cumplir la pena en la cárcel.
Cabe mencionar que Brasil es el país con más asesinatos de personas transgénero en los últimos años, que suman en total 1.741 casos entre 2008 y septiembre de 2022, muy por delante de México (649) y Estados Unidos (375), según los datos revelados por la ONG Transgender Europe.
Desde 2019, la homotransfobia era considerada como racismo, pero con la ley de injuria racial había quedado un limbo en su interpretación para los casos con personas LGBTIQ+. La decisión fue tomada luego de una votación en línea que finalizó el lunes 21 de agosto en la noche, que arrojó como resultado nueve votos a favor y solo uno en contra por los jueces del más alto tribunal.
