PLN presenta consulta a la Sala Constitucional sobre proyecto de jornadas
Consulta de constitucionalidad versa sobre las lesiones del proyecto de ley a la Constitución Política y tratados internacionales.
La Fracción de Liberación Nacional envió la tarde de este martes 15 de agosto de 2023, una consulta ante la Sala Constitucional sobre el expediente vN°21.182 “Reforma de los artículos 136, 142, 144, 205 y 274 y adición de los artículos 145 bis y 145 ter del Código de Trabajo, para actualizar las jornadas de trabajo excepcionales y resguardar los derechos de las personas trabajadoras”.
La consulta de constitucionalidad tiene como objetivo solicitar que dicho tribunal se pronuncie sobre las posibles lesiones a los derechos de las personas trabajadoras que contiene el proyecto de ley.
Las diputadas y los diputados consultantes argumentan que establecer jornadas de 12 horas diarias, como lo hace el texto aprobado en primer debate mediante supuestos abiertos e indeterminados, violenta la voluntad del constituyente para que la ley estableciera los casos de excepción muy calificados a las jornadas de ocho horas.
De la misma forma, la consulta subraya los roces del proyecto de ley con el artículo 56 constitucional, cuyo fin primordial es la protección de las personas trabajadoras, por las consecuencias negativas que las jornadas de 12 horas diarias tendrán sobre la salud, vida familiar y bienestar de la población.
