Tribunal ordena a Globalvía a pagar ₡30 millones a conductora que chocó contra aguja

En una sentencia dictada el pasado 17 de marzo por el Tribunal Segundo Colegiado de Primera Instancia Civil del I Circuito Judicial de San José, la empresa Autopistas del Sol S.A. (Globalvía), concesionaria de la ruta 27 fue condenada al pago de ₡30 millones de colones por el daño moral causado a una conductora que colisionó con una de las agujas del peaje en Ciudad Colón.
De acuerdo con el medio digital CRHoy.com, la resolución, a cargo de la jueza María Sophia Ramírez Rodríguez, confirma que el monto a pagar por el daño físico será determinado en la fase de ejecución de la sentencia.
La afectada presentó pruebas y dictámenes médico legales que confirmaron las múltiples lesiones físicas sufridas en el rostro y las fracturas en las extremidades inferiores como resultado del accidente.
El tribunal rechazó las excepciones de falta de legitimación y falta de derecho, y estableció el monto del daño moral en ₡30 millones, además de condenar a Autopistas del Sol al pago de intereses legales desde la firmeza del fallo hasta su efectivo pago.
El Poder Judicial indicó que la sentencia no está en firme y que el proceso se encuentra en conocimiento de la Sala Primera, luego de un recurso de casación presentado por la concesionaria contra lo dispuesto.
Cabe destacar que este incidente se suma a otros casos anteriores reportados por usuarios de la vía: en octubre de 2021, otro motociclista denunció que una aguja del QuickPass cayó sobre él mientras pasaba por el peaje de San Rafael de Escazú.
En 2011 un conductor identificado como Freddy Fonseca denunció que fue golpeado por una de las agujas ubicadas en uno de los carriles de cobro electrónico ubicado en el peaje de San Rafael de Escazú.
