Ratifican condena de 20 años contra excura Mauricio Víquez por abuso infantil
La defensa del exsacerdote, condenado por violación contra un menor de 11 años, presentó un recurso que fue rechazado por los magistrados.
La Sala Tercera ratificó la condena de 20 años de cárcel impuesta el 30 de marzo de 2022 al exsacerdote Mauricio Víquez Lizano por delitos sexuales en contra de un menor de edad.
El Ministerio Público comunicó este viernes el fallo, que agotó el último recurso legal que tenía la defensa de Víquez para anular la condena.
“La Fiscalía Adjunta de Género fue notificada sobre la resolución de la Sala de Casación Penal, en la que se rechaza el recurso de apelación interpuesto por la defensa técnica y se confirma la pena de 20 años de prisión en contra del exsacerdote, acusado de cometer los delitos de abuso sexual y violación agravada”, informó la Fiscalía en un comunicado de prensa.
El abogado de la víctima, Rodolfo Alvarado, indicó que la sentencia de la Sala III ratifica la resolución dictada por el Tribunal de Juicio y castiga «conductas realizadas por el sacerdote en contra de cuatro ciudadanos que al final tuvieron el valor de haberlo denunciado, aunque solamente uno de ellos terminó la causa penal».
Tras la divulgación de la denuncia, Víquez escapó a México el 7 de enero de 2019. Sin embargo, el 18 de agosto del mismo año, se le detuvo en Monterrey de Nuevo León, debido a una orden de captura internacional emitida. Después, fue extraditado a Costa Rica el 6 de mayo de 2020.
La condena del Tribunal Penal de Desamparados consistió en 14 años de prisión por un delito de violación agravada y otros seis años por abuso sexual contra persona menor de edad.
“La Fiscalía demostró que Víquez se aprovechó de su posición de poder, autoridad, relación de confianza con la víctima y de su condición de sacerdote para cometer las agresiones sexuales, en perjuicio de la persona ofendida”, indicó el Ministerio Público.
Los otros tres afectados, además de Alvarado, presentaron una demanda civil contra la Iglesia Católica. El 1 de febrero pasado, se anunció que se había llegado a un acuerdo confidencial entre las partes y que las demandas contra la Iglesia habían sido archivadas.
La sentencia civil a favor de Carlos Muñoz, una de las tres víctimas, fue emitida en agosto del 2022 por el Tribunal Segundo Colegiado de Primera Instancia Civil de San José, condenando a la Iglesia a pagar 65 millones de colones debido a la relación de dependencia que Víquez tenía con la Arquidiócesis de San José y al encubrimiento de sus acciones.
A pesar de esto, la Iglesia presentó un recurso ante la Sala Primera, lo que impedía que la sentencia fuera firme al momento del acuerdo confidencial.
