Jueza absuelve a Albino Vargas por llamado a bloquear fronteras y vías nacionales
La acción civil resarcitoria fue declarada sin lugar.
El secretario general de la Asociación Nacional de Empleados Públicos y Privados (ANEP), Albino Vargas Barrantes, fue absuelto la tarde de este jueves por el presunto delito de instigación pública a raíz de el llamado que hizo a bloquear calles y fronteras en el marco de una protesta en la que se exigía la renuncia del exministro de Educación, Edgar Mora Altamirano, en 2019.
El juicio dio inicio el pasado lunes 6 de diciembre en la sala 1 de Tribunal Penal del I Circuito de San José. El fiscal Óscar Quirós leyó sus conclusiones el miércoles y solicitó un año de prisión contra el líder sindical de 65 años.
De acuerdo con Quirós, Vargas generó daños irreparables para el país.
Sin embargo, en la sentencia leída la tarde de este jueves la jueza Lorena Blanco, indicó que en estricta aplicación de la ley consideraron que no se lograron acreditar los requisitos subjetivos y objetivos, tal y como lo explicó el abogado del sindicalista.
La denuncia por ese caso fue presentada en setiembre de 2019 por los abogados Gloria Navas y Rubén Hernández Valle luego de unas declaraciones que realizó Vargas en el auditorio de la Conferencia Episcopal, el 9 de setiembre de ese año. En la reunión, el dirigente exhortó a los miembros de la llamada Mesa Social Multisectorial a realizar cierres.
“La tesis de paro nacional es correcta, un gran paro nacional, pero de verdad: cerrar las fronteras, cerrar la 27, cerrar la 32, cerrar Ochomogo…, hasta obligar a que se sienten en la mesa los que nos ningunean”, declaró Vargas en aquel momento.
A la causa penal contra el líder sindical se unió la Procuraduría General de la República (PGR) y el Ministerio Público.
Margot Avellán, representante de la PGR, había cuantificado ₡1 millón por daño social. Pago del que también se libró Vargas.
