Eximen de responsabilidad a doctora que operó a Maricruz Leiva
Tribunal de Ética del Colegio de Médicos no encontró pruebas suficientes para suspender la licencia a la “doctora de las misses”.
El Tribunal de Ética Médica del Colegio de Médicos y Cirujanos de Costa Rica determinó que la doctora Jennifer Fallas Guevara no violentó ninguna norma interna de la institución cuando operó a la periodista Maricruz Leiva.
Es decir, a Fallas, quien también es conocida como la “doctora de las misses”, la eximieron de toda responsabilidad por los hechos que le achaca la periodista de espectáculos cuando le realizó una cirugía estética en 2018 en su clínica Médico Splendor.
Tras la denuncia presentada por la periodista, la fiscalía del Colegio de Médicos informó en junio del 2020 que la doctora habría cometido infracciones a varios de los artículos del Código de Ética del colegio, por lo que el caso se elevó a un juicio interno.
Hace unos días ambas partes recibieron la notificación de que el caso quedaba archivado, pues tanto el tribunal como la junta directiva de la entidad médica, no encontraron pruebas suficientes para proceder con la suspensión del ejercicio de la medicina ni aplicarle multas económicas a Fallas.
En entrevista con Diario Extra, la doctora Fallas se mostró complacida con el fallo.
“Me siento muy satisfecha con lo que resolvieron tanto el Tribunal de Ética como la Junta de Gobierno del Colegio de Médicos con respecto al caso y también mi abogado dio las declaraciones respectivas”, indicó.
Mientras que el abogado de Fallas, José Miguel Villalobos, aseguró por medio de sus redes sociales que es importante dejar claro que la doctora fue eximida de toda responsabilidad gremial por los hechos que se le atribuían.
“Tanto el Tribunal de Ética del Colegio de Médicos como su Junta Administrativa resolvieron que mi clienta, la doctora Jennifer Fallas, no violentó ninguna norma interna de ese ente y cerraron la investigación en su contra. Se le eximió de toda responsabilidad gremial por los hechos que se le atribuían por parte de la señora Leiva y la causa se archivó. Es importante escribir al respecto, porque cuando se inicia la investigación, la información mediática es profusa, pero cuando se determina que la persona actuó correctamente, se ignora la noticia”, destacó.
“Es importante no confundir a las personas”
Mauricio Brenes, abogado de Maricruz Leiva, comentó a Extra por medio de un escrito que: “Un abogado no litiga por las redes sociales. El estimable colega escoge hacerlo así, pero nosotros preferimos no incurrir en eso. Es importante no confundir a las personas, lo que ha emitido el Colegio de Médicos es una resolución en un proceso disciplinario interno; pero aún no está firme, pues todavía tiene recurso de revocatoria y de apelación ante el superior, a los cuales accederá doña Maricruz”.
“Este asunto no tiene nada que ver con el proceso penal por el delito de lesiones culposas (mala praxis) que se le reprocha a la Dra. Fallas, y que sigue su curso normal ante el Ministerio Público con independencia del proceso disciplinario del Colegio de Médicos. La lucha de doña Maricruz Leiva es precisamente para que este tipo de desinformación deje de circular”, agregó.
