México habilita venta de dispositivos electrónicos que calientan tabaco
Los dispositivos que vaporizan soluciones líquidas, continuarán prohibidos.
México habilitó la importación y venta de dispositivos electrónicos que calientan tabaco seco, levantando así una prohibición que regía para este tipo de productos.
Esto luego de que la Secretaría de Economía publicara en el Diario Oficial de la Federación (DOF) el decreto que avala la importación de dispositivos de calentamiento de cartuchos o unidades desmontables con tabaco.
En noviembre de 2020, la tabacalera ganó un recurso de amparo que le permitía comercializar su dispositivo en todo el territorio mexicano.
Con la publicación del decreto en el DOF, la dependencia ajustará la normativa a una sentencia de la Segunda Sala de la Suprema Corte de Justicia en la que se consideró inconstitucional prohibir el acceso de dispositivos que calientan el tabaco, con lo que evitan la combustión dictada en noviembre anterior
No a los vaporizadores
La Secretaría de Energía reiteró la prohibición para la importación, distribución, comercialización y exhibición de los Sistemas Electrónicos de Administración de Nicotina (SEAN) y los Sistemas Similares Sin Nicotina (SSSN), es decir, los vapeadores, que contengan o no nicotina.
La prohibición también aplica para los productos líquidos, y otros, que utilizan los vapeadores.
Otros casos en el mundo
Con el propósito de disminuir el daño provocado por el tabaco otros países han optado por avanzar en la incorporación de productos alternativos a los cigarrillos.
Tal es el caso de Uruguay, quien en marzo de este año tomó la misma decisión de permitir la comercialización de estas alternativas y levantó una prohibición que existía sobre estos productos desde el 2009.
El gobierno del presidente Luis Lacalle Pou, argumentó que hay “alternativas ofrecidas a partir del desarrollo de nuevas tecnologías en la industria” que permiten avanzar en esa línea.
“Existen dispositivos electrónicos para la administración de nicotina que emplean una tecnología mediante la cual se calienta tabaco seco, respecto de los que existen datos científicos que indican que los mismos resultan en una menor exposición de los usuarios a las sustancias tóxicas asociadas al consumo tradicional de tabaco”, indica parte del decreto.
