¡Se viene fin de semana largo! Feriado del 1° de mayo se traslada para el lunes
Este feriado es de pago doble obligatorio, pero solo para las personas que trabajen el lunes tres de mayo.
Se acerca el primer fin de semana largo del 2021, el 1° de mayo, fecha en la que se celebra el Día del Trabajador cae sábado, pero se traslada para el lunes 3 de mayo, por ley con el objetivo de que las personas tengan más días para pasear y así reactivar a los sectores que se han visto más golpeados por la pandemia de la covid-19.
“Lo primero que hay que considerar es que este es un feriado de pago obligatorio es decir, el trabajador tiene derecho a recibir su remuneración y disfrutar del feriado con independencia del tipo de trabajo que realice y con independencia de la forma o modalidad en la que se le pague su salario”, explicó el abogado Osvaldo Madriz a Telenoticias.
“Lo segundo es que si el trabajador labora este feriado se le debe reconocer doble su jornada laboral, es decir que debo de hacer un pago doble por las labores que realizó ese día el empleado”, agregó el jurista.
Este feriado es de pago doble obligatorio, pero solo para las personas que trabajen el lunes 3 de mayo.
Si labora el sábado 1° de mayo, no se le debe pagar doble por ese día de trabajo.
“Para este año en particular, debemos de considerar que el disfrute del 1° de mayo se traslada para el lunes 3 de mayo. Todo lo que acabamos de mencionar es de aplicación, pero para el 3 de mayo que es la fecha en que legalmente este año se debe disfrutar del día del trabajador es importante tomar en cuenta que si el patrono por la naturaleza de su giro comercial necesita que el empleado trabaje el 3 de mayo lo correspondiente sería, en primer lugar, cancelarle doble su salario como acabamos de mencionar o bien pactar con el trabajador el traslado a una fecha posterior de disfrute de este feriado”, finalizó Madriz.
