Mujeres criminalizadas por aborto podrán ser excluidas de sanción penal en Argentina
Aquellas mujeres y disidencias acusadas penalmente en Argentina por realizarse un aborto dentro de las 14 semanas de gestación podrán ser sobreseídas cuando entre en vigencia la nueva ley.
La legalización del aborto en Argentina permitirá que las mujeres y disidencias con acusaciones penales en curso por abortos realizados dentro de las 14 semanas de gestación sean sobreseídas; es decir, podrán ponerle fin al proceso penal sin llegar a una resolución de su caso.
La abogada feminista Soledad Deza, consultada por la agencia Télam, indicó que las mujeres criminalizadas dentro del primer trimestre de gestación podrán acceder a esta medida cuando entre en vigencia la nueva Ley de la Interrupción del Embarazo Voluntario (IVE).
“No es lo mismo que se archive la causa. Hay que sobreseerlas”, enfatizó la profesional.
La acción busca que las personas que decidieron interrumpir su embarazo antes de la norma aprobada no tengan represalias ni consecuencias en sus vidas por haber decidido sobre su cuerpo y sus proyectos personales. Un derecho legítimo que era negado hasta el pasado miércoles 30 de diciembre.
“Las causas se archivan si no hay sobreseimiento y el prontuario queda abierto. Entonces las mujeres no obtienen, por ejemplo, un certificado de buena conducta para acceder a empleos”, destacó Deza.
El Centro de Estudios Legales y Sociales (CELS), en el marco de la Campaña Nacional por el Derecho al Aborto Legal Seguro y Gratuito, había alertado que desde el 2012 al 2020 se detectó que 1.532 mujeres afrontaron procesos penales por aborto y 37 también fueron criminalizadas por eventos obstétricos. Todo ello ocurrió en 17 provincias argentinas, las cuales fueron analizadas por la organización.
Según explicó la abogada feminista a Télam, la aprobación de la legalidad del aborto disminuye la pena y, por ello, “hay muchas que deberían obtener el sobreseimiento”, ya que se modifica el artículo 85 del Código Penal argentino.
La nueva ley de la IVE indica que el o la que causante de aborto será reprimido “con prisión de tres (3) a diez (10) años, si obrare sin consentimiento de la persona gestante” y “quince (15) si el hecho fuere seguido de la muerte de la persona gestante”.
Asimismo, se sanciona legalmente “con prisión de tres (3) meses a un (1) año, si obrare con consentimiento de la persona gestante, luego de la semana catorce (14) de gestación”.
Deza precisó que inicialmente las mismas mujeres y disidencias acusadas por aborto deberán ser quienes soliciten esta figura legal; sin embargo, las colectivas trabajarán para que sea el mismo Estado quien lo ejecute.
“Es improbable que el Estado actúe de oficio, que los sobreseimientos sean automáticos, así que las y los defensores y activistas tendremos que ocuparnos”, finalizó.
